Employment Security
RELATING TO EMPLOYMENT SECURITY.
Sets, for calendar years 2010 and 2011, the wage base at 90% of the average annual wage. Sets, for calendar year 2010, the employer contribution rate at schedule D and for calendar year 2011, the employer contribution rate at schedule F. Retains the maximum weekly benefit rate at 75% of the average weekly wage until December 31, 2012. Returns the maximum weekly benefit rate to 70% of the average weekly wage on January 1, 2013. Authorizes special assessments upon employers to pay the principal and interest costs on loans received from the U.S. Secretary of Labor provided that the director of Labor and Industrial Relations develops a fair and equitable manner in which these payments are made. Establishes for recalculation of the adequate reserve fund beginning in 2011. (HB2169 HD2)

Captive Insurance Companies
RELATING TO CAPTIVE INSURANCE COMPANIES.
Amends the frequency of statutorily required captive insurance company examinations from once every three years to once every five years, unless otherwise required by the Insurance Commissioner. Requires risk retention captive insurance companies to undergo examination within three years of formation. Eliminates reference to a repealed provision on minimum surplus requirements for captive insurance companies. Requires protected cell accounts established by sponsored captive insurance companies to be operated only under the forms of business organizations authorized by the Insurance Commissioner. (SD1)

Amends the owner-builder law by: (1) Allowing an exemption for the sale or lease of a property by an owner builder prior to the expiration of the one-year prohibition period in the event of hardship; (2) Defining when a construction or improvement is completed; (3) Exempting improvements pursuant to an approved building permit where the estimated valuation as reflected in the building permit is less than $10,000; (4) Establishing fines for the failure of an owner-builder to comply with the requirements set forth in the disclosure statement provided to the owner-builder by the county. Creates the Permitted Transfers in Trust Act to govern transfers of currency, bonds, and securities from a transferor to a trustee by means of an irrevocable trust instrument. Authorizes the Department of Education (DOE) to adopt rules governing traffic and parking conditions on roadways and other areas under its jurisdiction, including rules for the assessment and collection of parking fees. Requires the fees collected to be deposited into the same fund into which fees and charges assessed and collected by DOE for the use of school facilities are deposited; provided that parking fees collected by a school shall be deposited to the credit of that school's nonappropriated local school fund account. RELATING TO INTOXICATING LIQUOR.
Limits operating hours of unlicensed bring-your-own bottle establishments. Requires brewpubs to conduct manufacturing and sales activities at one location other than at the licensee's premises, if the manufacture takes place in Hawaii and on other licensed locations of the licensee. Establishes new class 17 of bring-your-own-beverage license for counties with a population in excess of 500,000 and permissive for counties with a population of 500,000 or under. Allows patrons to bring home beer, liquor, and wine that was purchased or brought onto the premises of any class of licensee for consumption with a meal.
