Appropriates funds to the Department of the Prosecuting Attorney of the City and County of Honolulu for the Career Criminal Prosecution Unit, prosecution in Drug Court, Hawaii's Opportunity Probation with Enforcement Program, and Victim Witness Assistance Program. Agriculture; Hawaii-grown Coffee; Penal Code
RELATING TO AGRICULTURE.
Makes the offense of false labeling as to the geographic origin of Hawaii-grown coffee a class C felony. Authorizes the department of agriculture to adopt administrative rules relating to the inspection and documentation of the geographic origin of Hawaii-grown green coffee beans. Removes the requirement that all Hawaii-grown green coffee beans shall be inspected and certified by the Department of Agriculture unless otherwise specified by rules of the Department. Requires that no Hawaii-grown coffee beans shall be shipped outside the area of their geographic origin unless they have been marked with or contain documentation of geographic origin approved by the department of agriculture. Agricultural Loan Revolving Fund; Coffee Berry Borer Program
RELATING TO STATE FUNDS.
Authorizes the transfer during fiscal year 2012-2013 of $196,000 from the agricultural loan revolving fund to the pest inspection, quarantine, and eradication fund.  Appropriates $196,000 for a program to control and eradicate the coffee berry borer. Effective July 1, 2012. (HB283 CD1)

Public Lands; Leases; Fair Compensation
RELATING TO PUBLIC LANDS.
Provides for fair compensation when leased public land for agricultural or pastoral uses is withdrawn, condemned, or taken for public purposes. Authorizes the Board of Land and Natural Resources to extend commercial, hotel, resort, and industrial leases when the lessee makes qualifying substantial improvements to the leased land. One Call Center; Pest Control Operators; Exemption; Public Utilities Commission
RELATING TO THE ONE CALL CENTER.
Extends until June 30, 2015, the sunset provision in section 5 of Act 72, Session Laws of Hawaii 2009, which exempts pest control operators' activities from the definition of "excavation". Requires exempt pest control operators to attend training provided or approved by the Hawaii One Call Center. Requires the Public Utilities Commission to conduct an investigation on the risks of residential pest control application and report to the Legislature prior to the Regular Session of 2014. RELATING TO HAWAIIAN LANGUAGE.
Designates the month of February as "Olelo Hawai‘i Month" to celebrate and encourage the use of Hawaiian language. Requires that all letterheads, documents, symbols, and emblems of the State and other political subdivisions include accurate and appropriate Hawaiian names and language. Establishes references for accurate, appropriate, and authentic Hawaiian names and words, including proper Hawaiian spelling and punctuation. (HB1984 CD1)

Hospital Sustainability Fee; Hospital Sustainability Program Special Fund
RELATING TO HOSPITALS.
Establishes a hospital sustainability fee and the hospital sustainability program special fund to receive moneys from the hospital sustainability fee to receive federal medicaid matching funds under the QUEST Expanded Medicaid Section 1115 Demonstration Waiver. Requires the Department of Human Services to charge and collect a provider fee on health care items or services provided by hospitals. Effective July 1, 2012. Repealed on June 30, 2013. (HB2275 CD1)

RELATING TO BAIL.
Requires law enforcement agencies to accept cash bail, certified copies of pre-filed bail bonds, and original bail bonds when the court is closed, including nights, weekends, and holidays. Specifies from whom bail may be accepted. Requires prompt release after acceptance of bail. Effective 01/01/13 and repeal on 01/01/16. (CD1)

RELATING TO COLLECTIVE BARGAINING.
Clarifies provisions that negotiations relating to contributions to the Hawaii employer-union health benefits trust fund shall be to agree upon amounts that the State and counties shall contribute toward the payment of costs for a health benefits plan and group life insurance benefits for active public employees; clarifies that a decision of an arbitration panel shall be final. RELATING TO LAND USE.
Authorizes, within an agricultural district, agricultural tourism activities, including overnight accommodations of twenty-one days or less, for any one stay within a county; provided that the activities coexist with a bona fide agricultural activity and the county includes at least three islands and has adopted ordinances regulating agricultural tourism activities. RELATING TO PROFESSIONAL EMPLOYER ORGANIZATIONS.
Adds powers and duties to the Director of Labor and Industrial Relations regarding the registration and regulation of professional employer organizations. Authorizes various penalties for noncompliance; amends definitions and bond level requirements; and establishes the professional employer organization special fund. Repeals chapter 373K, Hawaii Revised Statutes, but moves the general excise tax exemption provisions to chapter 373L, Hawaii Revised Statutes. Appropriates funds to the Department of Labor and Industrial Relations. (CD1)

RELATING TO CLEAN AND SOBER HOMES AND HALFWAY HOUSES.
Establishes a temporary clean and sober home and halfway house task force that shall, among other things, establish a pilot clean and sober home and halfway house for a county with a population over 900,000. Requires the task force to submit a report to the legislature containing findings and recommendations and any proposed legislation that may be necessary to effectuate those recommendations. (CD1)

RELATING TO WASTEWATER.
Allows counties to permit the use of an otherwise authorized individual wastewater treatment system, except cesspools in a special management area, when it pre-dates a county-operated wastewater treatment system and the county determines that allowing the individual wastewater treatment system is fair and equitable. Requires counties to adopt rules or ordinances no later than December 31, 2014. (CD1)

Hawaii Community Development Authority; Projects
RELATING TO THE HAWAII COMMUNITY DEVELOPMENT AUTHORITY.
Amends the composition of the Hawaii Community Development Authority (HCDA) board to include nine voting members for each established district. Extends the HCDA's authority to lease all or a portion of the real or personal property constituting a project in the Kakaako Community Development District without public notice for sealed bids. Prohibits certain members of the HCDA from voting on matters concerning the Heeia Community Development District (HCDD). Permits county members on HCDA to vote on and be considered for quorum, except for issues relating to the HCDD. Requires the governor to appoint three additional voting members to the HCDA to represent the HCDD. (CD1)

Extends until June 30, 2016: the increase in the rental motor vehicle surcharge tax to $7.50 per day; the deposit of a portion of the tax into the general fund; and the suspension of the rental motor vehicle customer facility charges. Allocates a portion of the foregoing taxes for deposit to the rental motor vehicle customer facility charge special fund. Authorizes issuance of rental motor vehicle customer facility revenue bonds. RELATING TO THE TRANSIENT ACCOMMODATIONS TAX.
Clarifies that the daily $10 tax on transient accommodations furnished on a complimentary or gratuitous basis includes transient accommodations furnished as part of a travel package, but does not include transient accommodations furnished as part of a tourism industry promotional or marketing activity.
