Child Custody; Grandparent Visitation
RELATING TO CHILD VISITATION.
Permits family court to award reasonable visitation to grandparents if the denial of visitation would cause significant harm to the child. Establishes a rebuttable presumption that visitation decisions made by a parent are in the best interests of the child. Presumption may be rebutted by clear and convincing evidence. Makes entering or remaining unlawfully on unimproved or unused agricultural lands without permission an offense of criminal trespass in the second degree if the lands are fenced, enclosed, or secured, or a sign is displayed. Establishes limited liability of agricultural land owners for any injury, death, loss, or damage suffered by a trespasser. Promoting Prostitution; Witness Security and Protection
RELATING TO PROMOTING PROSTITUTION.
Makes various amendments regarding prostitution offenses. Amends section 28-101, Hawaii Revised Statutes, to give the "greatest priority" to cases involving promoting prostitution, when the attorney general is determining whether to fund or provide for witness security and protection. Increases the grade of offense for promoting prostitution in the first and second degree to a class A and B felony, respectively. Amends the elements of promoting prostitution in the second degree to include acts in violation of the offense of promoting prostitution in the third degree. Repeals the offense of promoting prostitution in the third degree. Expands the offenses of prostitution and solicitation of prostitution to cover patrons of prostitution. Makes the offense of habitual solicitation of prostitution a class C felony, and applies the law to those who habitually patronize prostitutes. Removes the sunset date of Act 192, Session Laws of Hawaii 2008. Effective July 1, 2011. (HB240 CD1)

Requires a person convicted of criminal property damage by graffiti to remove graffiti from property within two hundred fifty yards of the site of the offense, if the property owner consents and the act of removal does not endanger the person or others nor inconvenience the public. Allows the court to require the person to perform one hundred hours of community service in lieu of removing the graffiti, if the government agency supervising the removal does not have the resources to ensure the person's compliance with removing the graffiti.
