RELATING TO PUBLIC HOUSING.
Prohibits smoking in and around public housing projects or state low-income housing projects under the jurisdiction of the Hawaii public housing authority, with an exception for designated smoking areas. Allows for eviction upon a third violation of the smoking prohibition. (SD2)

Agricultural Loan Revolving Fund; Coffee Berry Borer Program
RELATING TO STATE FUNDS.
Authorizes the transfer during fiscal year 2012-2013 of $196,000 from the agricultural loan revolving fund to the pest inspection, quarantine, and eradication fund.  Appropriates $196,000 for a program to control and eradicate the coffee berry borer. Effective July 1, 2012. (HB283 CD1)

Public Lands; Leases; Fair Compensation
RELATING TO PUBLIC LANDS.
Provides for fair compensation when leased public land for agricultural or pastoral uses is withdrawn, condemned, or taken for public purposes. Authorizes the Board of Land and Natural Resources to extend commercial, hotel, resort, and industrial leases when the lessee makes qualifying substantial improvements to the leased land. RELATING TO PROCUREMENT.
Imposes time limits on rendering administrative and judicial review decisions. Limits protests to those that are a minimum percentage of the contract value. Requires posting of a protest bond, to be forfeited if the protesting party does not prevail. (SD2)

RELATING TO HAWAIIAN LANGUAGE.
Designates the month of February as "Olelo Hawai‘i Month" to celebrate and encourage the use of Hawaiian language. Requires that all letterheads, documents, symbols, and emblems of the State and other political subdivisions include accurate and appropriate Hawaiian names and language. Establishes references for accurate, appropriate, and authentic Hawaiian names and words, including proper Hawaiian spelling and punctuation. (HB1984 CD1)

RELATING TO THE TRICARE PROGRAM.
Extends the general excise tax exclusion for amounts received by a managed care support contractor of the TRICARE program for the actual cost or advancement to third party health care providers pursuant to a contract with the United States. Effective July 1, 2012. (SB2101 HD2)

RELATING TO BAIL.
Requires law enforcement agencies to accept cash bail, certified copies of pre-filed bail bonds, and original bail bonds when the court is closed, including nights, weekends, and holidays. Specifies from whom bail may be accepted. Requires prompt release after acceptance of bail. Effective 01/01/13 and repeal on 01/01/16. (CD1)

Collective Bargaining; Employer-Union Health Benefits
RELATING TO COLLECTIVE BARGAINING.
Clarifies provisions that negotiations relating to contributions to the Hawaii employer-union health benefits trust fund shall be to agree upon amounts that the State and counties shall contribute toward the payment of costs for a health benefits plan and group life insurance benefits for active public employees; clarifies that a decision of an arbitration panel shall be final. Professional Employer Organizations; Fees and Expenses; Bond Requirements; Appropriation
RELATING TO PROFESSIONAL EMPLOYER ORGANIZATIONS.
Adds powers and duties to the Director of Labor and Industrial Relations regarding the registration and regulation of professional employer organizations. Authorizes various penalties for noncompliance; amends definitions and bond level requirements; and establishes the professional employer organization special fund. Repeals chapter 373K, Hawaii Revised Statutes, but moves the general excise tax exemption provisions to chapter 373L, Hawaii Revised Statutes. Appropriates funds to the Department of Labor and Industrial Relations. (CD1)

RELATING TO CLEAN AND SOBER HOMES AND HALFWAY HOUSES.
Establishes a temporary clean and sober home and halfway house task force that shall, among other things, establish a pilot clean and sober home and halfway house for a county with a population over 900,000. Requires the task force to submit a report to the legislature containing findings and recommendations and any proposed legislation that may be necessary to effectuate those recommendations. (CD1)

Counties; Wastewater; Individual Systems
RELATING TO WASTEWATER.
Allows counties to permit the use of an otherwise authorized individual wastewater treatment system, except cesspools in a special management area, when it pre-dates a county-operated wastewater treatment system and the county determines that allowing the individual wastewater treatment system is fair and equitable. Requires counties to adopt rules or ordinances no later than December 31, 2014. (CD1)

Transportation; Rental Motor Vehicle Surcharge Tax; Rental Motor Vehicle Customer Facility Charges
RELATING TO TRANSPORTATION.
Extends until June 30, 2016: the increase in the rental motor vehicle surcharge tax to $7.50 per day; the deposit of a portion of the tax into the general fund; and the suspension of the rental motor vehicle customer facility charges. Allocates a portion of the foregoing taxes for deposit to the rental motor vehicle customer facility charge special fund. Authorizes issuance of rental motor vehicle customer facility revenue bonds. RELATING TO THE TRANSIENT ACCOMMODATIONS TAX.
Clarifies that the daily $10 tax on transient accommodations furnished on a complimentary or gratuitous basis includes transient accommodations furnished as part of a travel package, but does not include transient accommodations furnished as part of a tourism industry promotional or marketing activity.
