REPORT TITLE:
ADC


DESCRIPTION:
Changes the composition of the agribusiness development
corporation (ADC) board for a two-year period effective June 30,
1999.  Makes the members of the board of agriculture (BOA), the
ADC board of directors effective July 1, 2001.  Enables ADC to
develop, promote, assist, and market export crops and other crops
for local markets without BOA's approval. Appropriates funds for

                   A  BILL  FOR  AN  ACT

RELATING TO AGRICULTURE.
 


BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 163D-3, Hawaii Revised Statutes, is
 
 2 amended by amending subsection (b) to read as follows:
 
 3      "(b)  The board of directors of the corporation shall
 
 4 consist of eleven voting members, of whom eight shall be
 
 5 appointed by the governor [for staggered terms].  These eight
 
 6 members shall be selected on the basis of their knowledge,
 
 7 experience, and proven expertise in small and large businesses
 
 8 within the agricultural industry, agricultural economics,
 
 9 banking, real estate, finance, promotion, marketing, and
 
10 management.  Of these eight members, [four shall be selected by
 
11 the senate president and four shall be selected by the speaker of
 
12 the house of representatives; provided that two] one shall be
 
13 from the city and county of Honolulu, [two] one shall be from the
 
14 county of Hawaii, [two] one shall be from the county of Maui,
 
15 [and two] one shall be from the county of Kauai[.], and four
 
16 shall be appointed at-large.  The director of business, economic
 
17 development, and tourism; the chairperson of the board of
 
18 agriculture; and the chairperson of the board of land and natural

 1 resources, or their designated representatives, shall be ex-
 
 2 officio, voting members of the board.  All members shall continue
 
 3 in office until their respective successors have been appointed
 
 4 and qualified.  The board shall annually elect its chairperson
 
 5 from among its members; provided that the chairperson shall not
 
 6 be an ex-officio member."
 
 7      SECTION 2.  Section 163D-4, Hawaii Revised Statutes, is
 
 8 amended by amending subsection (b) to read as follows:
 
 9      "(b)  The corporation shall develop, promote, assist, and
 
10 market export crops and other crops for local markets [approved
 
11 by the board of agriculture]."
 
12      SECTION 3.  Act 176, Session Laws of Hawaii 1998, is amended
 
13 by amending section 19 to read as follows:
 
14      "SECTION 19.  This Act shall take effect on July 1, 1998;
 
15 provided that section 5 shall take effect on [July 1, 1999.] July
 
16 1, 2001."
 
17      SECTION 4.  There is appropriated out of the general
 
18 revenues of the State of Hawaii the sum of $400,000 or so much
 
19 thereof as may be necessary for fiscal year 1999-2000 for the
 
20 expenses incurred in the performance of the duties of the
 
21 agribusiness development corporation board.
 
22      The sum appropriated shall be expended by the department of
 
23 agriculture for the purposes of this Act.

 1      SECTION 5.  Statutory material to be repealed is bracketed.
 
 2 New statutory material is underscored.
 
 3      SECTION 6.  This Act shall take effect on June 30, 1999;
 
 4 provided that:
 
 5      (1)  Section 1 shall be repealed on June 30, 2001; and
 
 6      (2)  Section 4 shall take effect on July 1, 1999.
