                   A  BILL  FOR  AN  ACT

RELATING TO SERVICES FOR PERSONS WITH DEVELOPMENTAL DISABILITIES
   OR MENTAL RETARDATION.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  The purpose of this Act is to establish the
 
 2 developmental disabilities special fund to expand and enhance
 
 3 services for persons with developmental disabilities or mental
 
 4 retardation by maximizing federal reimbursements.  The special
 
 5 fund will allow the Department of Health to maximize its funds
 
 6 for community services in accordance with section 333F-2(e),
 
 7 Hawaii Revised Statutes, and expend funds received for the
 
 8 purposes of chapter 333F, Hawaii Revised Statutes, section
 
 9 333F-13.
 
10      SECTION 2.  Section 333F-17.5, Hawaii Revised Statutes, is
 
11 amended to read as follows:
 
12      "�333-F17.5  [Disposition of Title XIX funds.  All earned
 
13 Title XIX funds collected for community program services under
 
14 this chapter shall be deposited to the credit of the state
 
15 general fund.]  Developmental disabilities special fund.  There
 
16 is established in the state treasury a special fund to be known
 
17 as the developmental disabilities special fund to be administered
 
18 by the department in accordance with this section.  Program
 
19 income consisting of reimbursement funds received by the state
 
20 for targeted case management services for persons with

 1 developmental disabilities or mental retardation funded by
 
 2 legislative appropriation under this part shall be deposited into
 
 3 the special fund; provided that no state appropriations shall be
 
 4 deposited into the special fund.  The fund shall be used for
 
 5 Title XIX home and community based waiver services for persons
 
 6 with developmental disabilities or mental retardation."
 
 7      SECTION 3.  There is appropriated out of the developmental
 
 8 disabilities special fund the sum of $1,500,000 or so much
 
 9 thereof as may be necessary and available for fiscal year 1999-
 
10 2000 and the sum of $1,600,000 or so much thereof as may be
 
11 necessary and available for fiscal year 2000-2001 for Title XIX
 
12 home and community based waiver services for persons with
 
13 developmental disabilities or mental retardation.
 
14      SECTION 4.  The sums appropriated shall be expended by the
 
15 department of health for the purposes of this Act.
 
16      SECTION 5.  There is appropriated out of the department of
 
17 human services "U" fund in HMS 601 for Title XIX home and
 
18 community based waiver services for persons with developmental
 
19 disabilities or mental retardation an additional sum of
 
20 $1,500,000 or so much thereof as may be necessary and available
 
21 for fiscal year 1999-2000 and an additional sum of $1,600,000 or
 
22 so much thereof as may be necessary and available for fiscal year

 1 2000-2001.
 
 2      SECTION 6.  The sums appropriated shall be expended by the
 
 3 department of human services for the purposes of this Act.
 
 4      SECTION 7.  Statutory material to be repealed is bracketed.
 
 5 New statutory material is underscored.
 
 6      SECTION 8.  This Act shall take effect on July 1, 1999.
