                     A BILL FOR AN ACT

RELATING TO PRISONS.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  The legislature finds that the State is facing a
 
 2 crisis, wherein state correctional programs and facilities
 
 3 greatly exceed their capacity.  The State has responded to this
 
 4 situation by means of a redistribution of inmates among state
 
 5 facilities and by transferring prisoners to mainland United
 
 6 States institutions.  These responses, though helpful in reducing
 
 7 the overcrowding problem, will only offer temporary relief.  The
 
 8 legislature further finds that the construction of additional
 
 9 prison facilities will enable the State to house repeat offenders
 
10 and career criminals instead of releasing them prematurely into
 
11 the community without being rehabilitated.  This will help put an
 
12 end to the "revolving door" practice at our prisons.  The
 
13 legislature also finds that every reasonable effort should be
 
14 made to inform, involve, and benefit the communities considered
 
15 and ultimately elected for placement of any prison, in ways
 
16 including but not limited to the minimization of adverse
 
17 environmental and social impacts, job training and hiring
 
18 preferences, and the procurement of local products and services.

 1      The purpose of this Act is to appropriate funds to create
 
 2 prison space by constructing a medium security facility for the
 
 3 detention of serious offenders.  
 
 4      SECTION 2.  The director of finance is authorized to issue
 
 5 general obligation bonds in the sum of $     or so much thereof
 
 6 as may be necessary and the same sum or so much thereof as may be
 
 7 necessary is appropriated for fiscal year 1999-2000 for the
 
 8 following project for the department of public safety.
 
 9      1.   Design, construction, land, and equipment for a medium
 
10           security correctional facility on the island of Hawaii.

16      SECTION 3.  The appropriations made for the capital
 
17 improvement projects authorized in section 2 of this Act shall not
 
18 lapse at the end of the fiscal year in which the appropriation is
 
19 made; provided that all appropriations which are unencumbered as
 
20 of June 30, 2003, shall lapse as of that date.
 
21      SECTION 4.  The sum appropriated in section 2 of this Act
 
22 shall be expended by the department of accounting and general
 
23 services for the purposes of this Act.
