                   A  BILL  FOR  AN  ACT

RELATING TO SPEEDING.
 


BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Chapter 291C, Hawaii Revised Statutes, is
 
 2 amended by adding a new section to be appropriately designated
 
 3 and to read as follows:
 
 4      "�291C-    Speeding in a school zone or construction area.
 
 5 (a)  No person shall drive a motor vehicle at a speed greater
 
 6 than the maximum speed limit established pursuant to subsection
 
 7 (c) within a school zone or a construction area.
 
 8      (b)  Any person who violates this section shall be fined:
 
 9      (1) Not more than $400 for a first conviction thereof;
 
10      (2) Not more than $600 for conviction of a second offense
 
11 committed within one year after the date of the first offense;
 
12 and
 
13      (3) Not more than $1000 for conviction of a third or
 
14 subsequent offense committed within one year after the date of
 
15 the first offense.
 
16      (c)  The director of transportation, pursuant to section
 
17 291C-102, shall place official signs in a school zone or a
 
18 construction area, establishing the maximum speed limits.
 
19      (d)  For purposes of this section, the term "construction
 
20 area" includes but is not limited to any area in which there is
 
21 occurring the installation and construction of connections for

 1 streets, roads, driveways, concrete curbs and sidewalks,
 
 2 structures, drainage systems, landscaping or grading within the
 
 3 highway rights-of-way, excavation and backfilling of trenches or
 
 4 other openings in state highways, the restoration, replacement,
 
 5 or repair of the base course, pavement surfaces, highway
 
 6 structures, or any other highway improvements."
 
 7      SECTION 2.  This Act does not affect rights and duties that
 
 8 matured, penalties that were incurred, and proceedings that were
 
 9 begun, before its effective date.
 
10      SECTION 3.  Statutory material to be repealed is bracketed.
 
11 New statutory material is underscored.
 
12      SECTION 4.  This Act shall take effect upon its approval.
