                   A  BILL  FOR  AN  ACT

RELATING TO THE HAWAII COMMUNITY DEVELOPMENT AUTHORITY.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1                              PART I.
 
 2      SECTION 1.  The legislature finds that Piers 1 and 2 at Fort
 
 3 Armstrong include vital and unique maritime cargo facilities that
 
 4 cannot be relocated and would be prohibitively expensive to
 
 5 duplicate.  Piers 1 and 2, as well as access roads and backup
 
 6 lands to these piers, must be protected and preserved:  to ensure
 
 7 safe and navigable turning basins, channels, and approaches to
 
 8 berths; to allow for upgrading of existing cargo handling
 
 9 facilities; to expand and improve these facilities consistent
 
10 with the predicted growth of future cargo requirements; and for
 
11 the safe and effective berthing of major cargo vessels.
 
12      Accordingly, the purpose of this Part is to change the
 
13 boundaries of the Kakaako community development district to
 
14 exclude Pier 1 and Pier 2 at Fort Armstrong.
 
15      SECTION 2.  Section 206E-32, Hawaii Revised Statutes, is
 
16 amended to read as follows:
 
17      "�206E-32  District; established, boundaries.  The Kakaako
 
18 community development district is established.  The district
 
19 shall include that area bounded by:  King Street; Piikoi Street

 1 from its intersection with King Street to Ala Moana Boulevard;
 
 2 Ala Moana Boulevard, inclusive, from Piikoi Street to its
 
 3 intersection with the Ewa boundary of Ala Moana Park, also
 
 4 identified as the Ewa boundary of tax map key 2-3-37:01; the Ewa
 
 5 boundary of tax map key 2-3-37:01 from its intersection with Ala
 
 6 Moana Boulevard to the shoreline; the shoreline from its
 
 7 intersection with the property line representing the Ewa boundary
 
 8 of property identified by tax map key 2-3-37:01 to the [property
 
 9 line between Pier 2 and Pier 4; the property line between Pier 2
 
10 and Pier 4 from its intersection with the shoreline to Ala Moana
 
11 Boulevard; Ala Moana Boulevard from its intersection with the
 
12 property line between lands identified by Pier 2 and Pier 4]
 
13 Keawe drainage canal; the Keawe drainage canal, inclusive, from
 
14 its intersection with the shoreline to Keawe Street; Keawe
 
15 Street, inclusive, from Keawe drainage canal to its intersection
 
16 with Ala Moana Boulevard, except for that parcel of land
 
17 identified as tax map key 2-21-15:44; Ala Moana Boulevard,
 
18 inclusive, from its intersection with Keawe Street to Punchbowl
 
19 Street; and Punchbowl Street to its intersection with King
 
20 Street.
 
21      The district shall also include that parcel of land
 
22 identified by tax map key 2-1-14:16, situated mauka of Pier 6 and
 
23 Pier 7 and makai of Nimitz Highway, being the site for the

 1 existing Hawaiian Electric power plant and related facilities."
 
 2                             PART II.
 
 3      SECTION 3.  The cruise ship industry has experienced large
 
 4 growth rates both in Hawaii and around the world.  While for many
 
 5 years the airplane has been the preferred mode of travel,
 
 6 passenger cruising has become more popular.  There are several
 
 7 reasons for this:
 
 8      (1)  Cruising is a better value than traditional air-land
 
 9           vacation package when all costs are considered.
 
10      (2)  According to the cruise industry, the maturing baby
 
11           boom industry is ready to travel.  They have both the
 
12           money and time to go ocean cruising.
 
13      (3)  Finally, because airlines have cut travel agents
 
14           commissions while cruise lines still give travel agents
 
15           full commission, travel agents encourage cruises more
 
16           than airline travel.
 
17      There is a current worldwide boom in cruise travel.  To meet
 
18 this boom, cruise lines are building cruise ships in record
 
19 numbers.  Besides becoming more numerous, the new ships are much
 
20 larger than the older ships.
 
21      The purpose of this Part is to appropriate moneys toward,
 
22 and to express strong legislative and community support for,
 
23 additional cruise ship berths in Honolulu Harbor.  The Oahu

 1 Commercial Harbors 2020 Master Plan recommends that, in order to
 
 2 increase Hawaii's share of the global cruise tour market,
 
 3 Honolulu Harbor must provide more cruise ship berths.
 
 4      SECTION 4.  There is appropriated out of the revenues of the
 
 5 harbor special fund of the State of Hawaii the sum of
 
 6 $___________ or so much thereof as may be necessary, for fiscal
 
 7 year 1999-2000, for the planning, design, and construction of a
 
 8 cruise ship passenger terminal at Pier 2, Honolulu Harbor.
 
 9      The sum appropriated shall be expended by the department of
 
10 transportation for the purposes of this Part.
 
11      SECTION 5.  Statutory material to be repealed is bracketed.
 
12 New statutory material is underscored.
 
13      SECTION 6.  This Act shall take effect upon its approval;
 
14 provided that section 4 of this Act shall take effect on July 1,
 
15 1999.
