                   A  BILL  FOR  AN  ACT

RELATING TO ADVANCED PRACTICE REGISTERED NURSES.
 


BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Chapter 431:10A, Hawaii Revised Statutes, is
 
 2 amended by adding a new section to be appropriately designated
 
 3 and to read as follows:
 
 4      "�431:10A-     Coverage and reimbursement for services of
 
 5 advanced practice registered nurses.  Each policy of accident and
 
 6 sickness insurance issued or renewed in this State, each employer
 
 7 group health policy, contract, plan, or agreement issued or
 
 8 renewed in this State, all health insurance policies issued or
 
 9 renewed in this State, all policies providing family coverages as
 
10 defined in section 431:10A-103, and all policies providing
 
11 reciprocal beneficiary family coverage as defined in section
 
12 431:10A-601, shall contain a provision for coverage and equitable
 
13 reimbursement for services of advanced practice registered nurses
 
14 as recognized in section 457-8.5."
 
15      SECTION 2.  Chapter 432:1, Hawaii Revised Statutes, is
 
16 amended by adding a new section to be appropriately designated
 
17 and to read as follows:
 
18      "�432:1-     Coverage and reimbursement for services of
 
19 advanced practice registered nurses.  All individual and group

 1 hospital and medical service plan contracts and medical service
 
 2 corporation contracts under this chapter shall provide coverage
 
 3 and equitable reimbursement for services of advanced practice
 
 4 registered nurses as recognized in section 457-8.5."
 
 5      SECTION 3.  Section 386-1, Hawaii Revised Statutes, is
 
 6 amended by amending the definition of "health care provider" to
 
 7 read as follows:
 
 8      ""Health care provider" means a person qualified by the
 
 9 director to render health care and service and who has a license
 
10 for the practice of:
 
11      (1)  Medicine under chapter 453;
 
12      (2)  Dentistry under chapter 448;
 
13      (3)  Chiropractic under chapter 442;
 
14      (4)  Osteopathy under chapter 460;
 
15      (5)  Naturopathy under chapter 455;
 
16      (6)  Optometry under chapter 459;
 
17      (7)  Podiatry under chapter 463E; [and]
 
18      (8)  Psychology under chapter 465[.]; and
 
19      (9)  Advanced practice registered nursing under section
 
20           457-8.5."
 
21      SECTION 4.  Section 386-27, Hawaii Revised Statutes, is
 
22 amended by amending subsection (a) to read as follows:
 
23      "(a)  All health care providers rendering health care and

 1 services under this chapter shall be qualified by the director
 
 2 and shall remain qualified by satisfying the requirements
 
 3 established in this section.  The director shall qualify any
 
 4 person initially who has a license for the practice of:
 
 5      (1)  Medicine under chapter 453;
 
 6      (2)  Dentistry under chapter 448;
 
 7      (3)  Chiropractic under chapter 442;
 
 8      (4)  Osteopathy under chapter 460;
 
 9      (5)  Naturopathy under chapter 455;
 
10      (6)  Optometry under chapter 459;
 
11      (7)  Podiatry under chapter 463E; [or]
 
12      (8)  Psychology under chapter 465[.]; or
 
13      (9)  Advanced practice registered nursing under section
 
14           457-8.5."
 
15      SECTION 5.  Section 431:10C-103.5, Hawaii Revised Statutes,
 
16 is amended by amending subsection (a) to read as follows:
 
17      "(a)  Personal injury protection benefits, with respect to
 
18 any accidental harm, means all appropriate and reasonable
 
19 treatment and expenses necessarily incurred as a result of the
 
20 accidental harm and which are substantially comparable to the
 
21 requirements for prepaid health care plans, including medical,
 
22 hospital, surgical, professional, nursing, dental, optometric,
 
23 chiropractic, ambulance, prosthetic services, products and

 1 accommodations furnished, x-ray, psychiatric, physical therapy
 
 2 pursuant to prescription by a medical doctor, occupational
 
 3 therapy, rehabilitation, advanced practice nursing as recognized
 
 4 in section 457-8.5, and therapeutic massage by a licensed massage
 
 5 therapist when prescribed by a medical doctor."
 
 6      SECTION 6.  Section 432D-23, Hawaii Revised Statutes, is
 
 7 amended to read as follows:
 
 8      "[[]�432D-23[]]  Required provisions and benefits.
 
 9 Notwithstanding any provision of law to the contrary, each
 
10 policy, contract, plan, or agreement issued in the State after
 
11 January 1, 1995, by health maintenance organizations pursuant to
 
12 this chapter, shall include benefits provided in sections
 
13 431:10-212, 431:10A-115, 431:10A-115.5, 431:10A-116,
 
14 431:10A-116.5, [and] 431:10A-116.6, 431:10A-   , and chapter
 
15 431M."
 
16      SECTION 7.  Statutory material to be repealed is bracketed.
 
17 New statutory material is underscored.
 
18      SECTION 8.  This Act shall take effect upon its approval.
