DESCRIPTION:
Creates the position of chief financial officer of the public
school system.  Requires the chief financial officer to be
nominated and, by and with the advice and consent of the senate,
appointed by the BOE.  Subjects the removal of the chief

                   A  BILL  FOR  AN  ACT

RELATING TO A CHIEF FINANCIAL OFFICER FOR THE DEPARTMENT OF
   EDUCATION.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 302A-1101, Hawaii Revised Statutes, is
 
 2 amended to read as follows:
 
 3      "[[]�302A-1101[]]  Department of education; board of
 
 4 education; superintendent of education[.]; chief financial
 
 5 officer.  (a)  There shall be a principal executive department to
 
 6 be known as the department of education, which shall be headed by
 
 7 an elected policy-making board to be known as the board of
 
 8 education.  The board shall have power in accordance with law to
 
 9 formulate statewide educational policy, adopt student performance
 
10 standards and assessment models, monitor school success, [and to]
 
11 appoint the superintendent of education as the chief executive
 
12 officer of the public school system[.], and appoint a chief
 
13 financial officer of the public school system.
 
14      (b)  The board shall appoint, and may remove, the
 
15 superintendent by a majority vote of its members.  The
 
16 superintendent:
 
17      (1)  May be appointed without regard to the state residency
 
18           provisions of section 78-1(b);
 
19      (2)  May be appointed for a term of up to four years; and

 1      (3)  May be terminated only for cause.
 
 2      (c)  The chief financial officer shall be nominated and, by
 
 3 and with the advice and consent of the senate, appointed by the
 
 4 board.  The removal of the chief financial officer shall be
 
 5 subject to the advice and consent of the senate.  The chief
 
 6 financial officer shall operate under the direction of the
 
 7 superintendent and shall be responsible for the accurate and
 
 8 relevant collection and reporting of financial information on the
 
 9 public school system."
 
10      SECTION 2.  There is appropriated out of the general
 
11 revenues of the State of Hawaii the sum of $        , or so much
 
12 thereof as may be necessary for fiscal year 1999-2000, and the
 
13 sum of $        , or so much thereof as may be necessary for
 
14 fiscal year 2000-2001, for the creation of a chief financial
 
15 officer of the public school system.
 
16      SECTION 3.  The sums appropriated shall be expended by the
 
17 department of education for the purposes of this Act.
 
18      SECTION 4.  Statutory material to be repealed is bracketed.
 
19 New statutory material is underscored.
 
20      SECTION 5.  This Act shall take effect on July 1, 1999.
