                     HOUSE  CONCURRENT
                        RESOLUTION
  PERTAINING TO MEDICAL USE OF CANNABIS.



 1        WHEREAS, a number of chemical substances are used under
 2   state and federal laws to provide relief from pain and to
 3   advance healing; and
 4   
 5        WHEREAS, these substances are controlled by licensed
 6   practitioners to be issued to those that need the relief from
 7   pain or the healing properties of these "controlled
 8   substances"; and
 9   
10        WHEREAS, there has been significant research and evidence
11   that cannabis has provided relief for many people from a
12   variety of physical and mental conditions; and
13   
14        WHEREAS, there are a number of infirm people in this State
15   that could benefit from the physiological and mental effects of
16   cannabis; and
17   
18        WHEREAS, Hawaii state law provides for a defense for the
19   "ultimate user of dangerous, harmful, or detrimental drugs
20   pursuant to a lawful prescription" from prosecution; and
21   
22        WHEREAS, Alaska, California, Oregon, Washington, Colorado,
23   and Arizona all have a similar "legal defense" built into their
24   current penal codes that allow for the cultivation, use, and
25   distribution of medical cannabis; and
26   
27        WHEREAS, this issue has received the attention of the
28   Hawaii Legislature during past and present sessions; and
29   
30        WHEREAS, the Governor of the State of Hawaii has endorsed
31   the legal use of cannabis for medical purposes; now, therefore,
32   
33        BE IT RESOLVED by the House of Representatives of the
34   Twentieth Legislature of the State of Hawaii, Regular Session
35   of 1999, the Senate concurring, that Hawaii state law does
36   allow for the legal cultivation, possession, transport, and use

 1   of cannabis for medical purposes only under the care and
 2   supervision of those individuals licensed in the State of
 3   Hawaii to prescribe approved substances; and
 4   
 5        BE IT FURTHER RESOLVED that any cannabis eradication
 6   effort or program be adjusted to allow for the cultivation,
 7   transport, and possession of cannabis for medical purposes.
