                     HOUSE  RESOLUTION

REQUESTING A STUDY TO DETERMINE THE ADVANTAGES AND DISADVANTAGES
   OF DESIGNATING THE PRINCIPAL OF EACH PUBLIC SCHOOL AS A
   LIMITED CHIEF PROCUREMENT OFFICER.



 1       WHEREAS, the Hawaii public procurement code (Procurement
 2   Code) was overhauled in 1993, when the Legislature passed Act
 3   8, Special Session Laws of Hawaii 1993, which intended to
 4   create a sense of fairness by establishing policy to be applied
 5   equally and uniformly to the State and counties; and
 6   
 7       WHEREAS, while the intent of the Procurement Code is
 8   laudable, its implementation has been cumbersome, especially
 9   for public schools, and the unintended result has been delays
10   that prevent schools from operating efficiently; and
11   
12       WHEREAS, school purchases are often unnecessarily
13   restricted by waiting for approvals, and delays have been
14   dramatically apparent in the attempt by schools to keep up with
15   technology; and
16   
17       WHEREAS, one concept that has been proposed to solve the
18   procurement problem for schools is to authorize principals to
19   make certain kinds of purchases for their schools that are
20   exempt from the Procurement Code; and
21   
22       WHEREAS, under this concept, exempted purchases would be
23   made public and published quarterly on a school-by-school basis
24   to ensure that principals make reasonable purchasing decisions;
25   now, therefore,
26   
27       BE IT RESOLVED by the House of Representatives of the
28   Twentieth Legislature of the State of Hawaii, Regular Session
29   of 1999, that the Legislative Reference Bureau is requested to
30   conduct a study to determine the advantages and disadvantages
31   of designating the principal of each public school as a limited
32   chief procurement officer for the purpose of making purchases
33   for the school that are exempted from the Hawaii Public
34   Procurement Code under chapter 103D, Hawaii Revised Statutes;
35   and
36   
37       BE IT FURTHER RESOLVED that the Department of Education is
38   requested to cooperate with the Legislative Reference Bureau in
39   conducting this study; and

 1       BE IT FURTHER RESOLVED that the Director of the Legislative
 2   Reference Bureau submit to the Legislature no later than twenty
 3   days prior to the convening of the Regular Session of 2000 a
 4   report of its findings, conclusions, and recommendations,
 5   including proposed legislation, if applicable; and
 6   
 7       BE IT FURTHER RESOLVED that certified copies of this
 8   Resolution be transmitted to the Governor, the Director of the
 9   Legislative Reference Bureau, the Chairperson of the Board of
10   Education, the Superintendent of Education, and the
11   Administrator of the State Procurement Office.
