                     HOUSE  RESOLUTION

  REQUESTS THE GOVERNOR AND THE HEAD OF EACH STATE EXECUTIVE
    AGENCY TO TAKE NECESSARY MEASURES AND ADOPT AN ACTION PLAN
    TO ENCOURAGE THE PRIVATE SECTOR TO PROVIDE SERVICES TO THE
    PUBLIC WHENEVER POSSIBLE RATHER THAN THE GOVERNMENT.



 1          WHEREAS, private business is the foundation of our
 2   nation and State's economies, providing jobs for citizens and
 3   tax revenues for governments.  The citizens of Hawaii desire a
 4   government that will encourage private business to flourish;
 5   and
 6   
 7          WHEREAS, it is extremely difficult for private business,
 8   especially small business, to survive, much less thrive, in an
 9   environment that promotes ventures with prima facie unfair
10   competitive advantages; and it is wrong for the government to
11   create such an environment by participating in these ventures;
12   and
13   
14          WHEREAS, the government uses public moneys appropriately
15   in providing services to its citizens that cannot be provided
16   reasonably by the private sector, for example, a bus system
17   that offers an affordable transportation option.  It is
18   inappropriate, however, for government to use public moneys to
19   subsidize ventures that directly compete with the private
20   sector.  This undermines our free enterprise system and
21   inhibits private sector growth, which in turn decreases
22   government tax revenue; and
23   
24          WHEREAS, in developing service for the public,
25   government must look first to the private sector to provide
26   that service.  Government should provide incentives to the
27   private sector, which will encourage private business to
28   initiate and improve services for the public; now, therefore,
29   
30          BE IT RESOLVED by the House of Representatives of the
31   Twentieth Legislature of the State of Hawaii, Regular Session
32   of 1999, that the Governor and the head of each executive
33   agency in state government are requested to take such measures
34   as may be necessary to ensure that all executive agencies
35   comply with the following principles:

 2          (1)  When government seeks to develop a service for the
 3               public, it shall first determine if the private
 4               sector can provide that service;
 5   
 6          (2)  Government shall encourage the private sector to
 7               initiate new services and improve existing services
 8               by providing business incentives;
 9   
10          (3)  Government shall not engage in ventures utilizing
11               public moneys to provide services that can be found
12               or created in the private sector.  Government shall
13               not compete with private business;
14   
15    and
16   
17          BE IT FURTHER RESOLVED that the heads of all executive
18   agencies are requested to adopt action plans to implement these
19   principles; and
20   
21          BE IT FURTHER RESOLVED that the heads of all executive
22   agencies are requested to report their progress in developing
23   an action plan and in implementing these principles, including
24   any relevant findings and recommendations and the need for the
25   enactment of implementing legislation, to the Legislature no
26   later than twenty days before the convening of the Regular
27   Session of 2000; and
28   
29          BE IT FURTHER RESOLVED that certified copies of this
30   Resolution be transmitted to the Governor and to the head of
31   each executive agency in state government.
