State Librarian


DESCRIPTION:
Allows the Board of Education to appoint the State Librarian
without regard to state residency provisions and for a term of up
to 4 years.  Allows the Board of Education to set the salary of

                   A  BILL  FOR  AN  ACT

RELATING TO THE STATE LIBRARIAN.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 312-2.1, Hawaii Revised Statutes, is
 
 2 amended to read as follows:
 
 3      "�312-2.1  Appointment of state librarian; duties; salary.
 
 4 (a)  The state librarian shall be appointed by the board of
 
 5 education, without regard to chapters 76 and 77, [shall serve at
 
 6 the pleasure of the board,] shall be under the direction of the
 
 7 board, and shall be responsible for the operation, planning,
 
 8 programming, and budgeting of all community/school and public
 
 9 libraries within the State[.] and may be removed by a majority
 
10 vote of its members.  The state librarian may be appointed:
 
11      (1)  Without regard to the state residency provisions of
 
12           section 78-1(b);
 
13      (2)  For a term of up to four years.
 
14      (b)  The salary of the state librarian shall be set by the
 
15 board of education[.  Effective January 1, 1989, and January 1,
 
16 1990, the salary shall be not more than $81,629 and $85,302 a
 
17 year, respectively.]; provided that effective July 1, 2004, the
 
18 salary of the state librarian shall be set by the legislature."
 
19      SECTION 2.  Statutory material to be repealed is bracketed.
