                   A  BILL  FOR  AN  ACT

RELATING TO THE STATE AQUARIUM.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Act 184, Session Laws of Hawaii 1995, as amended
 
 2 by Act 187, Session Laws of Hawaii 1997, is amended by amending
 
 3 section 6 to read as follows:
 
 4      "SECTION 6.  State aquarium transition.(a)
 
 5 Notwithstanding any other law to the contrary, the current
 
 6 management arrangements with the research corporation of the
 
 7 University of Hawaii and the University of Hawaii foundation
 
 8 shall continue until a new management arrangement is approved by
 
 9 the board of regents or until June 30, [1999,] 2004, whichever
 
10 occurs earlier.
 
11      (b)  All permanent full-time general fund positions
 
12 currently held by state employees presently assigned to the
 
13 Waikiki Aquarium shall remain as such; provided that in the event
 
14 a management arrangement with a nonprofit corporation is approved
 
15 by the board of regents pursuant to this section, and section
 
16 [304-   ,] 304-30, Hawaii Revised Statutes, the employees shall
 
17 remain as such under the supervision of that nonprofit
 
18 corporation; and provided further that any proposed changes shall
 
19 be subject to chapter 89, Hawaii Revised Statutes, and the

 1 applicable collective bargaining agreements."
 
 2      SECTION 2.  Statutory material to be repealed is bracketed.
 
 3 New statutory material is underscored.
 
 4      SECTION 3. This Act shall take effect upon its approval.
