                   A  BILL  FOR  AN  ACT

RELATING TO MARITIME.
 


BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  The legislature finds that Piers 1 and 2 at Fort
 
 2 Armstrong include vital and unique maritime cargo facilities that
 
 3 cannot be relocated and would be prohibitively expensive to
 
 4 duplicate.  Piers 1 and 2, as well as access roads and backup
 
 5 lands to these piers, must be protected and preserved:  to ensure
 
 6 safe and navigable turning basins, channels, and approaches to
 
 7 berths; to allow for upgrading of existing cargo handling
 
 8 facilities; to expand and improve these facilities consistent
 
 9 with the predicted growth of future cargo requirements; and for
 
10 the safe and effective berthing of major cargo vessels.
 
11      Accordingly, the purpose of this Act is to change the
 
12 boundaries of the Kakaako community development district to
 
13 exclude Pier 1 and Pier 2 at Fort Armstrong.
 
14      SECTION 2.  Section 206E-32, Hawaii Revised Statutes, is
 
15 amended to read as follows:
 
16      "�206E-32  District; established, boundaries.  The Kakaako
 
17 community development district is established.  The district
 
18 shall include that area bounded by:  King Street; Piikoi Street
 
19 from its intersection with King Street to Ala Moana Boulevard;

 1 Ala Moana Boulevard, inclusive, from Piikoi Street to its
 
 2 intersection with the Ewa boundary of Ala Moana Park, also
 
 3 identified as the Ewa boundary of tax map key 2-3-37:01; the Ewa
 
 4 boundary of tax map key 2-3-37:01 from its intersection with Ala
 
 5 Moana Boulevard to the shoreline; the shoreline from its
 
 6 intersection with the property line representing the Ewa boundary
 
 7 of property identified by tax map key 2-3-37:01 to the [property
 
 8 line between Pier 2 and Pier 4; the property line between Pier 2
 
 9 and Pier 4 from its intersection with the shoreline to Ala Moana
 
10 Boulevard; Ala Moana Boulevard from its intersection with the
 
11 property line between lands identified by Pier 2 and Pier 4]
 
12 Keawe drainage canal; the Keawe drainage canal, inclusive, from
 
13 its intersection with the shoreline to Keawe Street; Keawe
 
14 Street, inclusive, from Keawe drainage canal to its intersection
 
15 with Ala Moana Boulevard, except for that parcel of land
 
16 identified as tax map key 2-21-15:44; Ala Moana Boulevard,
 
17 inclusive, from its intersection with Keawe Street to Punchbowl
 
18 Street; and Punchbowl Street to its intersection with King
 
19 Street.
 
20      The district shall also include that parcel of land
 
21 identified by tax map key 2-1-14:16, situated mauka of Pier 6 and
 
22 Pier 7 and makai of Nimitz Highway, being the site for the
 
23 existing Hawaiian Electric power plant and related facilities."

 1      SECTION 3.  Statutory material to be repealed is bracketed.
 
 2 New statutory material is underscored.
 
 3      SECTION 4.  This Act shall take effect upon its approval.
