                   A  BILL  FOR  AN  ACT

RELATING TO WASTEWATER.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Chapter 340B, Hawaii Revised Statutes, is
 
 2 amended by adding a new section to be appropriately designated
 
 3 and to read as follows:
 
 4      "�340B-    Board of certification special fund.  (a)  There
 
 5 is established in the state treasury a special fund to be known
 
 6 as the board of certification special fund.  The following moneys
 
 7 collected by the board shall be deposited into the special fund:
 
 8      (1)  Registration fees for examinations;
 
 9      (2)  Renewal fees;
 
10      (3)  Reciprocity fees; and
 
11      (4)  Temporary certificates fees.
 
12 All interest earned or accrued on moneys deposited into the
 
13 special fund shall become a part of the special fund.
 
14      (b)  All moneys paid into the special fund shall be expended
 
15 by the board to finance its operations."
 
16      SECTION 2.  Section 340B-11, Hawaii Revised Statutes, is
 
17 amended to read as follows:
 
18      "[[]�340B-11[]]  Powers and duties of the board.  To carry
 
19 out the provisions and purposes of this chapter, the board shall:

 2      (1)  Perform any and all acts and adopt, amend, or repeal
 
 3           such rules [and regulations] as it finds necessary or
 
 4           appropriate;
 
 5      (2)  Enter into agreements, contracts, or cooperative
 
 6           arrangements, under such terms and conditions as deemed
 
 7           appropriate with other state, federal, or interstate
 
 8           agencies, municipalities, educational institutions, or
 
 9           other organizations or individuals;
 
10      (3)  Receive financial and technical assistance from the
 
11           federal government and other public or private
 
12           agencies;
 
13      (4)  Participate in related programs of the federal
 
14           government, other states, interstate agencies, or other
 
15           public or private agencies or organizations;
 
16      (5)  Furnish upon request to federal, state, or interstate
 
17           agencies, municipalities, educational institutions and
 
18           other organizations and individuals, reports,
 
19           information, and materials relating to the
 
20           certification program authorized by this chapter;
 
21      (6)  Revoke, suspend, or refuse to renew any certificate of
 
22           any individual following a hearing before the board of
 
23           the individual or the individual's designated
 
24           representative, when it is determined that the

 1           individual has practiced fraud or deception; that
 
 2           reasonable care, judgment, or the application of the
 
 3           individual's knowledge or ability was not used in the
 
 4           performance of the individual's duties; or that the
 
 5           individual is incompetent or unable to properly perform
 
 6           the individual's duties; provided that the board gives
 
 7           the person concerned notice and hearing in conformity
 
 8           with chapter 91;
 
 9      (7)  Delegate those duties and responsibilities the board
 
10           may deem appropriate for the purpose of administering
 
11           requirements of this chapter;
 
12      (8)  Establish and collect such fees for application,
 
13           conduct examinations, issue or renew certificates as
 
14           are necessary for the support of this chapter, and
 
15           deposit all fees collected into the [State's general]
 
16           the board of certification special fund; and
 
17      (9)  Oversee the development and implementation of a
 
18           continuous training program if that is necessary to
 
19           carry out this chapter."
 
20      SECTION 3.  Statutory material to be repealed is bracketed.
 
21 New statutory material is underscored.
 
22      SECTION 4.  This Act shall take effect upon its approval.
