                   A  BILL  FOR  AN  ACT

RELATING TO THE TRANSPORTATION OF SCHOOL CHILDREN.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 302A-406, Hawaii Revised Statutes, is
 
 2 amended to read as follows:
 
 3      "[[]�302A-406[]]  Transportation of school children.(a)
 
 4 The department may provide suitable transportation to and from
 
 5 school and for educational field trips for all public school
 
 6 children in grades kindergarten to twelve [and], in special
 
 7 education classes[.] and in the Hawaiian immersion program.  The
 
 8 department shall adopt [such policy, procedure, and program]
 
 9 policies, procedures, and programs as it deems necessary to
 
10 provide suitable transportation[.] for these children.  In
 
11 formulating [the policy, procedure, and program,] these policies,
 
12 procedures, and programs, the department shall consider [the]:
 
13      (1)  The school district; [the]
 
14      (2)  The school attendance area in which a public school
 
15           child normally resides; [the]
 
16      (3)  The distance the [school] child lives from the school;
 
17           [the]
 
18      (4)  The availability of public carriers or other means of
 
19           transportation; [the]

 1      (5)  The frequency, regularity, and availability of public
 
 2           transportation; [and the]
 
 3      (6)  The grade level, physical [handicap,] disability, or
 
 4           special learning disability of [a school] the child,
 
 5           and [it may also consider such]
 
 6      (7)  The conditions and circumstances unique or peculiar to
 
 7           a county or area.
 
 8      (b)  The department shall adopt rules under chapter 91
 
 9 governing the supervision and administration of the
 
10 transportation of school children [under this section.]; provided
 
11 that:
 
12      (1)  The department shall allow the transportation of public
 
13           school students participating in the Hawaiian language
 
14           immersion program between departmental school districts
 
15           on the same island; and
 
16      (2)  The department of accounting and general services shall
 
17           work jointly with parent support organizations of the
 
18           public schools in which the Hawaiian immersion program
 
19           is located, on routes and centralized pick up and drop
 
20           off areas for students in the program."
 
21      SECTION 2.  Statutory material to be repealed is bracketed.

 1      SECTION 3.  This Act shall take effect upon its approval.
