DESCRIPTION:
Allows animal shelters to stock controlled substances for the use
in animal euthanasia and to certify individuals who are not
veterinarians to administer the controlled substances in animal

                   A  BILL  FOR  AN  ACT

RELATING TO ANIMAL EUTHANASIA.


BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 2      SECTION 1.  Chapter 329, Hawaii Revised Statutes, is amended
 
 3 by adding a new section to be appropriately designated and to
 
 4 read as follows:
 
 5      "�329-     County contracted animal shelter facilities.  (a)
 
 6 Registration of a county contracted animal shelter facility is
 
 7 required when a county contracted animal shelter facility
 
 8 acquires, administers, or maintains centralized ordering,
 
 9 storage, and record keeping of controlled substances within the
 
10 State in order to provide humane euthanasia of animals.
 
11 Registration of a county contracted animal shelter facility
 
12 requires that:
 
13      (1)  Each location where controlled substances are
 
14           administered shall be registered by name and location.
 
15           The application for registration shall be signed by the
 
16           facility administrator.  The facility administrator
 
17           shall be the person in charge of the day to day
 
18           operations of the county contracted animal shelter
 
19           facility and shall be responsible for the accurate
 
20           maintenance of records that document all controlled

 1           substances ordered, received, and administered by the
 
 2           facility;
 
 3      (2)  Controlled substances stocked at a county contracted
 
 4           animal shelter facility under its State of Hawaii and
 
 5           Drug Enforcement Administration registration numbers
 
 6           shall be administered by a licensed veterinarian or any
 
 7           duly authorized person employed by the facility that
 
 8           has been certified by a licensed veterinarian in the
 
 9           use of controlled substances in humanely destroying
 
10           animals, and who has met the requirements set forth in
 
11           section 329-33 relating to prior convictions and drug
 
12           use.  The director of public safety may adopt rules
 
13           regarding the type and number of hours of training
 
14           required to be certified in the use of controlled
 
15           substances to humanely destroy animals;
 
16      (3)  The county contracted animal shelter facility shall
 
17           keep copies of training certifications for all duly
 
18           authorized employees certified under this section.
 
19           These certificates shall be kept at the facility and
 
20           made available for review by a representative of the
 
21           department of public safety upon reasonable request;
 
22      (4)  The county contracted animal shelter facility shall
 
23           keep centralized records of inventories, and treatment

 1           charts signed and dated by the facility administrator
 
 2           that identify the animal treated, controlled substance
 
 3           used, and the date and time of administration.  These
 
 4           records shall be maintained with the current controlled
 
 5           substance inventory, ordering, and receipt records.
 
 6           These records shall be maintained for five years;
 
 7      (5)  The county contracted animal shelter facility shall
 
 8           submit in writing to the director of public safety for
 
 9           approval a protocol for the use of specific controlled
 
10           substances by duly authorized employees, certified
 
11           under this section, to humanely destroy animals prior
 
12           to acquiring or administering any controlled substance;
 
13      (6)  A veterinarian who individually maintains a personal
 
14           stock of controlled substances does so under the
 
15           veterinarian's individual state and Drug Enforcement
 
16           Administration registration number.  These controlled
 
17           substances must be kept separate from the county
 
18           contracted animal shelter facility's stock and can only
 
19           be utilized by that veterinarian.  Nothing in this
 
20           section shall operate to limit the professional
 
21           practice of a licensed veterinarian employed or acting
 
22           on behalf of an animal shelter as otherwise prescribed
 
23           in this section.

 1      (b)  A veterinarian who trains and certifies individuals as
 
 2 described in this section is not civilly or criminally liable for
 
 3 the subsequent actions and use of a controlled substance by those
 
 4 individuals or by the county contracted animal shelter facility.
 
 5 This section does not limit liability for the actions of a
 
 6 veterinarian irrespective of the training and certification of
 
 7 individuals described in this section.
 
 8      (c)  As used in this section, "county contracted animal
 
 9 shelter facility" means any society or organization under
 
10 contract with a county to provide animal care control services
 
11 pursuant to sections 143-15 and 143-16."
 
12      SECTION 2.  New statutory material is underscored.
 
13      SECTION 3.  This Act shall take effect upon its approval.
