                   A  BILL  FOR  AN  ACT

RELATING TO ALTERNATIVE DISPUTE RESOLUTION.
 


BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Pilot project established.  There is established
 
 2 in the center for alternative dispute resolution a public policy
 
 3 pilot project.  The project shall provide a program of offering
 
 4 alternative dispute resolution services to address public policy
 
 5 issues.  The center for alternative dispute resolution shall
 
 6 designate the public policy issues that are appropriate for
 
 7 alternative dispute resolution services by developing criteria
 
 8 and a selection process, notwithstanding chapter 92, Hawaii
 
 9 Revised Statutes.
 
10      The criteria for whether or not public policy issues are
 
11 appropriate for alternative dispute resolution services shall
 
12 include, but not be limited to:
 
13      (1)  The number of people involved;
 
14      (2)  The extent of impact on the State's economy;
 
15      (3)  The degree of controversy;
 
16      (4)  Whether there is an opportunity for resolution;
 
17      (5)  Whether the major issue stakeholders are expected to
 
18           participate in the alternative dispute resolution

 1           process; and
 
 2      (6)  The potential to enable the community to effectively
 
 3           address community issues and problems.
 
 4      The center for alternative dispute resolution shall also
 
 5 develop procedures to empower community initiation of alternative
 
 6 dispute resolution services related to public policy issues as
 
 7 part of the pilot project.
 
 8      SECTION 2.  The center for alternative dispute resolution
 
 9 shall submit a report on the status of the project along with any
 
10 findings and recommendations to the governor and the legislature
 
11 at least twenty days before the convening of the 2000 regular
 
12 session.
 
13      SECTION 3.  There is appropriated out of the general
 
14 revenues of the State of Hawaii the sum of $50,000, or so much
 
15 thereof as may be necessary for fiscal year 1999-2000, to carry
 
16 out the purposes of this Act.
 
17      SECTION 4.  The sum appropriated shall be expended by the
 
18 judiciary for the purposes of this Act.
 
19      SECTION 5.  This Act shall take effect on July 1, 1999.
