                   A  BILL  FOR  AN  ACT

RELATING TO EDUCATION. 


BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Chapter 302D, Hawaii Revised Statutes, is
 
 2 amended by adding a new section to be appropriately designated
 
 3 and to read as follows:
 
 4      "�302D-    Public school facilities maintenance.  (a)
 
 5 Notwithstanding any law to the contrary, each public school with
 
 6 the consent of the department may enter into a contract with a
 
 7 community group or private contractor to maintain or upgrade
 
 8 school facilities, including but not limited to, swimming pools,
 
 9 auditoriums, and computer equipment, if:
 
10      (1)  The entity to be awarded the contract has the expertise
 
11           required for the project; and
 
12      (2)  The entity offers a competitive contract price that is
 
13           not more than the lowest bid price that could be
 
14           expected if the project was subject to comptetitive
 
15           bidding.
 
16      (b)  Procurement of services or construction under
 
17 subsection (a) shall be considered as a sole source procurement
 
18 under section 103D-306, except that section 103D-306(c) shall not
 
19 apply."

 1      SECTION 2.  New statutory material is underscored.
 
 2      SECTION 3.  This Act shall take effect upon its approval.
