DESCRIPTION:
Suspends driver's license for 6 months, requires 100 hours of
community service and attendance at alcohol and drug education
program if an underage person violates liquor laws.  For repeat
offenders, suspends driver's license for one year and 150 hours

                   A  BILL  FOR  AN  ACT
RELATING TO INTOXICATING LIQUOR.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 281-101.5, Hawaii Revised Statutes, is
 
 2 amended by amending subsection (d) to read as follows:
 
 3      "(d)  Any person under age eighteen who violates this
 
 4 section shall be subject to the jurisdiction of the family court.
 
 5 If the family court determines that the person violated this
 
 6 section, the driver's license shall be suspended for six months,
 
 7 the person shall perform one hundred hours of offense-related
 
 8 community service and, accompanied by a parent or guardian,
 
 9 attend an alcohol and drug education program provided by the
 
10 court.  Any person age eighteen or older who violates subsection
 
11 (a) shall be guilty of a misdemeanor.  Any person age eighteen to
 
12 twenty-one who violates subsections (b) or (c) shall be guilty of
 
13 a petty misdemeanor[.]; and upon subsequent conviction shall be
 
14 required to perform one hundred fifty hours of offense-related
 
15 community service and shall have the person's driver's license
 
16 suspended for one year.  The driver's license of any person age
 
17 eighteen to twenty-one who violates this section shall be
 
18 suspended for six months, the person shall perform one hundred
 
19 hours of offense-related community service and shall attend an
 
20 alcohol and drug education program provided by the court.

 1      For repeat offenses under subsection (b) or (c), the
 
 2 person's driver's license shall be suspended for one year and the
 
 3 person shall perform one hundred fifty hours of offense-related
 
 4 community service.
 
 5      SECTION 2.  This Act does not affect rights and duties that
 
 6 matured, penalties that were incurred, and proceedings that were
 
 7 begun, before its effective date.
 
 8      SECTION 3.  Statutory material to be repealed is bracketed.
 
 9 New statutory material is underscored.
 
10      SECTION 4.  This Act shall take effect upon its approval.
