                    SENATE  CONCURRENT
                        RESOLUTION

  REQUESTING THE BOARD OF EDUCATION TO REVIEW THE SALARY OF THE
    ASSISTANT LIBRARIAN FOR THE HAWAII PUBLIC LIBRARY SYSTEM
    TO ENSURE THAT COMPENSATION FOR THE POSITION IS FAIR AND
    EQUITABLE.



 1        WHEREAS, section 312-2.2, Hawaii Revised Statutes (HRS),
 2   establishes the position of special assistant to the state
 3   librarian; and 
 4   
 5        WHEREAS, this position was allegedly established
 6   politically in 1989 for a certain individual by former Governor
 7   John Waihee; and
 8    
 9        WHEREAS, the duties of the special assistant to the state
10   librarian set forth under section 312-2.2, HRS, include,
11   "assist the state librarian, as the state librarian may
12   require, in the initiation, direction, or monitoring of
13   administrative or managerial special projects, studies,
14   investigations, ... monitor and apprise the state librarian of
15   the activities of the various national, regional, state, and
16   local organizations and committees in which the state librarian
17   has membership, participation, or interest"; and 
18   
19        WHEREAS, the special assistant to the state librarian is
20   appointed by the state librarian and pursuant to section
21   312-2.2, HRS, is exempted from the civil service law which
22   establishes the state system of personnel administration based
23   on merit principles and scientific methods governing the
24   classification of positions and the employment of public
25   officers and employees; and 
26   
27        WHEREAS, currently, the salary for the special assistant
28   to the state librarian is $91,068, while the salary for the
29   state librarian is $85,302; and 
30   
31        WHEREAS, unlike the state librarian, the special assistant
32   receives salary increases in conjunction with the State's
33   collective bargaining Unit 13, even though the special
34   assistant is not a member of civil service and part of Unit 13;

 1   and
 2   
 3        WHEREAS, pay inequities such as this creates morale
 4   problems among State employees who feel that it is a result of
 5   political favoritism; now, therefore,
 6   
 7        BE IT RESOLVED by the Senate of the Twentieth Legislature
 8   of the State of Hawaii, Regular Session of 1999, the House of
 9   Representatives concurring, that the Board of Education review
10   and make recommendations as to the salary of the assistant
11   librarian to ensure that the compensation is commensurate with
12   the duties of the position; and
13   
14        BE IT FURTHER RESOLVED that the Board of Education make
15   recommendations as to whether the assistant librarian should be
16   re-classified as an employee subject to the State civil service
17   law; and
18   
19        BE IT FURTHER RESOLVED that the Board of Education is
20   requested to report findings and recommendations to the
21   Legislature twenty days before the convening of the Regular
22   Session of 2000; and
23   
24        BE IT FURTHER RESOLVED that a certified copy of this
25   Concurrent Resolution be transmitted to the Board of Education.
