Sir:

     Your Committee on Judiciary and Hawaiian Affairs, to which
was referred H.B. No. 1142, H.D. 1, entitled: 

     "A BILL FOR AN ACT RELATING TO ENVIRONMENT,"

begs leave to report as follows:

     The purpose of this bill is to:

     (1)  Place certification of cesspool pumping firms with the
          Department of Health;

     (2)  Subject knowing violations of rules regarding spills
          and dumping to criminal penalties:

     (3)  Allow officials of the Department of Health to obtain
          search warrants for criminal violations;

     (4)  Provide consistent penalties for wastewater and sludge
          spills and dumping; and

     (5)  Make explicit the Department of Health's authority to
          deal with recycled water.

     Testimony in support of this bill was received from the
Department of Health.

     Your Committee finds that this bill will strengthen the
authority of the Department of Health to deal effectively with
wastewater environment concerns.

     Your Committee amended this bill by adding a definition to
Section 342D-1, Hawaii Revised Statutes, for the term "recycled
water".

     As affirmed by the record of votes of the members of your
Committee on Judiciary and Hawaiian Affairs that is attached to
this report, your Committee is in accord with the intent and
purpose of H.B. No. 1142, H.D. 1, as amended herein, and
recommends it be referred to the Committee on Finance, in the
form attached hereto as H.B. No. 1142, H.D.2.
