Sir:

     Your Committee on Judiciary, to which was referred S.B. No.
921 entitled: 

     "A BILL FOR AN ACT RELATING TO DISTRICT COURT,"

begs leave to report as follows:

     The purpose of this bill is to amend section 604-8, Hawaii
Revised Statutes, relating to the jurisdiction of the district
court, by deleting reference to charges brought by complaint or
indictment.

     Your Committee finds that Act 64, Session Laws of Hawaii,
1998, provided for concurrent jurisdiction between the district,
circuit, and family courts over certain offenses.  Thus, the
district court has concurrent jurisdiction with the family court
for any violation of an order issued pursuant to chapter 586 or
any violation of section 709-906, when multiple offenses are
charged through complaint or indictment and at least one other
offense is a criminal offense within the jurisdiction of the
district court.  Your Committee further finds that the district
court does not require that offenses be charged through
"complaint or indictment" nor is it a common court practice.

     Testimony in support of this measure was submitted by the
Department of the Prosecuting Attorney of the City and County of
Honolulu.

     As affirmed by the record of votes of the members of your
Committee on Judiciary that is attached to this report, your

Committee is in accord with the intent and purpose of S.B. No.
921 and recommends that it pass Second Reading and be placed on
the calendar for Third Reading.
