                   A  BILL  FOR  AN  ACT

RELATING TO BOATING ENFORCEMENT.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Chapter 200, Hawaii Revised Statutes, is
 
 2  amended by adding a new section to be appropriately designated
 
 3 and to read as follows:
 
 4      "�200-    Enforcement.  (a)  The board of land and natural
 
 5 resources may grant to harbor agents and recreational harbor
 
 6 managers of the division of boating and ocean recreation, in
 
 7 addition to the conservation and resources enforcement officers
 
 8 appointed pursuant to chapter 199, authority to enforce this
 
 9 chapter and the rules adopted pursuant thereto by issuance of a
 
10 summons and citation for any violation of this chapter and
 
11 related rules.  Harbor agents and recreational harbor managers of
 
12 the division of boating and ocean recreation granted enforcement
 
13 authority under this section shall not bear firearms.  The
 
14 enforcement authority granted under this section shall
 
15 supplement, rather than replace, but not enlarge, the existing
 
16 authority of every state and county officer charged with
 
17 enforcement of state laws to enforce and assist in the
 
18 enforcement of this chapter and all rules adopted pursuant to
 
19 this chapter.

 1      (b)  Nothing herein shall preclude the enforcement of state
 
 2 or federal laws and requirements pursuant to agreements or other
 
 3 arrangements entered into between the chairperson and appropriate
 
 4 officers and agencies of the United States and other states to
 
 5 ensure the fullest possible cooperation in promoting and
 
 6 attaining the declared policy of section 200-21."
 
 7      SECTION 2.  New statutory material is underscored.
 
 8      SECTION 3.  This Act shall take effect upon its approval.
