                   A  BILL  FOR  AN  ACT

RELATING TO DISPOSITION OF LANDS.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 171-53, Hawaii Revised Statutes, is
 
 2 amended by amending subsection (c) to read as follows:
 
 3      "(c)  The board, with the prior approval of the governor and
 
 4 the prior authorization of the legislature by concurrent
 
 5 resolution, may lease submerged lands and lands beneath tidal
 
 6 waters under the terms, conditions, and restrictions provided in
 
 7 this chapter; provided that the approval of the governor and
 
 8 authorization of the legislature shall not be required for any
 
 9 grant of easement or lease of submerged lands or lands beneath
 
10 tidal waters used for moorings, cables, or pipelines[;], or
 
11 submerged lands or lands beneath tidal waters set aside by the
 
12 governor pursuant to section 171-11 for commercial or
 
13 recreational harbors; provided further that this exemption shall
 
14 not apply to easements for cables used for interisland electrical
 
15 transmission or slurry pipelines used for transportive materials,
 
16 mined at sea, or waste products from processing of the same.  The
 
17 lease shall provide that the lands shall be reclaimed at the
 
18 expense of the lessee.  Title to the reclaimed lands shall remain
 
19 in the State."

 1      SECTION 2.  Statutory material to be repealed is bracketed.
 
 2 New statutory material is underscored.
 
 3      SECTION 3.  This Act shall take effect upon its approval.
