                   A  BILL  FOR  AN  ACT

RELATING TO LIVING WAGES.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  The Hawaii Revised Statutes is amended by adding
 
 2 a new chapter to be appropriately designated and to read as
 
 3 follows:
 
 4                             "CHAPTER
 
 5                           LIVING WAGES
 
 6         -1  Applicability.(a)  This chapter shall apply to any
 
 7 employer who contracts with the State to provide services or
 
 8 labor to or on behalf of the State.
 
 9      (b)  This chapter shall not apply to contracts that merely
 
10 provide for the purchase of goods or other property or the
 
11 leasing of property.
 
12         -2 Payment of minimum compensation to employees.(a)
 
13 Employers subject to this chapter shall pay their employees a
 
14 wage of not less than $7.25 per hour with health benefits, as
 
15 described in subsection (b), or otherwise $9.50 per hour.
 
16      (b)  Health insurance benefits shall consist of the payment
 
17 of at least $1.25 per hour towards family medical insurance for
 
18 employees.  Proof of health insurance benefits must be submitted
 
19 to the department of labor and industrial relations within ten

 1 days after execution of the contract or receipt of state
 
 2 financial assistance to qualify for the reduced hourly wage rate
 
 3 for employees provided with health care benefits.
 
 4         -3 Supersession by collective bargaining agreement.  If
 
 5 parties subject to this chapter provide greater compensation for
 
 6 employees than that provided by this chapter through a collective
 
 7 bargaining agreement, the agreement shall supersede the
 
 8 requirements of this chapter.
 
 9         -4  Enforcement.  All service or labor contracts with
 
10 the State to which this chapter applies shall provide that if a
 
11 violation of any provision of this chapter occurs and is not
 
12 corrected after written notice, the State, at its option, may do
 
13 any of the following:
 
14      (1)  Suspend or terminate the contract or financial
 
15           assistance agreement for cause;
 
16      (2)  Require the employer to pay any amounts underpaid in
 
17           violation of the required payments, the State's
 
18           administrative costs, liquidated damages, and in the
 
19           case of financial assistance, refund any of the sums
 
20           disbursed by the State."
 
21      SECTION 2.  This Act shall take effect upon its approval.
