Animal Quarantine; User Fees


DESCRIPTION:
Reduces the user fee of the animal quarantine station by an
unspecified percentage of the user fee rate that existed on
January 1, 2000.  Forgives the moneys to be deposited from the
animal quarantine special fund into the general fund.
Appropriates funds from the general fund for deposit into the

                   A  BILL  FOR  AN  ACT

RELATING TO AGRICULTURE AND ANIMALS.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  The legislature declares that keeping Hawaii
 
 2 rabies-free is a public health and safety concern, and that the
 
 3 cost of animal quarantine should be borne by all the people of
 
 4 Hawaii and not only those people who are required to use the
 
 5 services and facilities of the animal quarantine station.
 
 6      The purpose of this Act is to:
 
 7      (1)  Reduce the user fee of the animal quarantine station by
 
 8           a certain percentage of the user fee rate that existed
 
 9           on January 1, 2000;
 
10      (2)  Forgive the moneys to be deposited from the animal
 
11           quarantine special fund into the general fund; and
 
12      (3)  Appropriate funds from the general fund into the animal
 
13           quarantine special fund.
 
14      SECTION 2.  Section 142-28.5, Hawaii Revised Statutes, is
 
15 amended to read as follows:
 
16      "[[]�142-28.5[]] Animal quarantine special fund.  (a) There
 
17 is established the animal quarantine special fund to be
 
18 administered by the board of agriculture.  All moneys received by
 
19 the board of agriculture as fees for the quarantine of cats,
 
20 dogs, and other carnivores pursuant to this chapter, or any state

 1 appropriations or other moneys made available for the cost of
 
 2 quarantine, shall be deposited into the special fund.  All
 
 3 interest earned or accrued on moneys deposited in the special
 
 4 fund shall become part of the special fund.  Moneys in the
 
 5 special fund shall be expended to cover all costs of quarantine
 
 6 but not limited to the costs of salaries, fringe benefits,
 
 7 operating expenses, equipment, motor vehicles, contract with any
 
 8 qualified person or entity for animal care services, operation
 
 9 and maintenance of the quarantine station, and promotional
 
10 expenses.  A reserve shall be appropriated and maintained in the
 
11 special fund to cover contingency costs including but not limited
 
12 to accrued vacation leave, unemployment insurance, and workers'
 
13 compensation.
 
14      (b)  No moneys in the animal quarantine special fund shall
 
15 be transferred to the general fund."
 
16      SECTION 3.  Section 142-98, Hawaii Revised Statutes, is
 
17 amended by amending subsection (a) to read as follows:
 
18      "(a)  The department of agriculture may establish and assess
 
19 fees pursuant to chapter 91 for facilities usage, vaccination
 
20 programs, emergency transportation of quarantined animals,
 
21 insecticides, medication, and other goods and services deemed
 
22 necessary and provided by the department of agriculture in
 
23 enforcing the provisions of this chapter; provided that the

 1 assessment of these fees does not violate any other provision of
 
 2 this chapter.  The user fee shall be reduced by     per cent of
 
 3 the user fee rate that existed on January 1, 2000."
 
 4      SECTION 4.  There is appropriated out of the general
 
 5 revenues of the State of Hawaii the sum of $300,000 or so much
 
 6 thereof as may be necessary for fiscal year 2000-2001 and the sum
 
 7 of $300,000 or so much thereof as may be necessary for fiscal
 
 8 year 2001-2002 for deposit into the animal quarantine special
 
 9 fund.
 
10      The sum appropriated shall be expended by the department of
 
11 agriculture.
 
12      SECTION 5.  Statutory material to be repealed is bracketed.
 
13 New statutory material is underscored.
 
14      SECTION 6.  This Act shall take effect on July 1, 2000.
