DESCRIPTION:
Extends the period of time a rental car company has to provide
the address of a lessee who incurs a parking citation while using

                   A  BILL  FOR  AN  ACT

RELATING TO PARKING CITATIONS.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 291C-168.5, Hawaii Revised Statutes, is
 
 2 amended to read as follows:
 
 3      "[[]�291C-168.5[]]  Liability of lessee for parking
 
 4 citation.  Notwithstanding any other law to the contrary, if the
 
 5 registered owner of record is the lessor of a rental or U-drive
 
 6 motor vehicle, as defined in section 286-2 pursuant to a written
 
 7 lease agreement, the lessee at the time of the issuance of the
 
 8 parking citation shall be responsible for such summons or
 
 9 citation; provided, however, said lessor shall be responsible for
 
10 such summons or citation if the lessor does not provide the court
 
11 having jurisdiction over the summons or citation the name and
 
12 address of the lessee within [forty-five] sixty days after a
 
13 notice containing the date, time, and location of the violation
 
14 and the license number of the vehicle is sent to lessor[;
 
15 provided further that the administrative judge of the court
 
16 having jurisdiction over the citation or summons may waive the
 
17 requirement of providing the name and address of the lessee by
 
18 the lessor and impose an administrative fee of five dollars per
 
19 citation on the lessor]."
