                   A  BILL  FOR  AN  ACT
RELATING TO THE UNIVERSITY OF HAWAII.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 87-1, Hawaii Revised Statutes, is
 
 2 amended by amending the definition of "employee" to read as
 
 3 follows:
 
 4     "(5)  "Employee" means an employee or officer of the state or
 
 5           county government or the legislature,
 
 6           (A)  Including:
 
 7                (i)  An elective officer or a person who has
 
 8                     served as a member of the legislature for at
 
 9                     least ten years;
 
10               (ii)  A per diem employee;
 
11              (iii)  An officer or employee under an authorized
 
12                     leave of absence;
 
13               (iv)  An employee of the Hawaii national guard
 
14                     although paid from federal funds;
 
15                (v)  A retired member of the employees' retirement
 
16                     system, the county pension system, or the
 
17                     police, firefighters, or bandsmen pension
 
18                     system of the State or county[;], and
 
19                     excluding retired University of Hawaii
 
20                     employees who opted to become members of the

 1                     optional retirement system under section 88-8
 
 2                     and have not vested in the state employees'
 
 3                     retirement system;
 
 4               (vi)  A salaried and full-time member of a board,
 
 5                     commission, or agency appointed by the
 
 6                     governor or the mayor of a county; and
 
 7              (vii)  A person employed by contract for a period
 
 8                     not exceeding one year, where the director of
 
 9                     human resources development, personnel
 
10                     services, or civil service has certified that
 
11                     the service is essential or needed in the
 
12                     public interest and that, because of
 
13                     circumstances surrounding its fulfillment,
 
14                     personnel to perform the service cannot be
 
15                     obtained through normal civil service
 
16                     recruitment procedures,
 
17           (B)  But excluding:
 
18                (i)  A designated beneficiary of a retired member
 
19                     of the employees' retirement system, the
 
20                     county pension system, or the police,
 
21                     firefighters, or bandsmen pension system of
 
22                     the State or county;
 
23               (ii)  Except as allowed under [[paragraph]

 1                     (5)(A)(vii),] subparagraph (A)(vii), a person
 
 2                     employed temporarily on a fee or contract
 
 3                     basis; and
 
 4              (iii)  A person employed for less than three months
 
 5                     and whose employment is less than one-half of
 
 6                     a full-time equivalent position."
 
 7      SECTION 2.  Section 88-8, Hawaii Revised Statutes, is
 
 8 amended as follows:
 
 9      1.  By amending subsection (e) to read:
 
10      "(e)  The employer's share of the cost of the optional
 
11 retirement plan of the optional retirement system of the
 
12 University of Hawaii shall not exceed [the equivalent amount for
 
13 any other group covered by this chapter.] an amount equal to ten
 
14 per cent of the employee's annual salary and one hundred per cent
 
15 of the total cost of health insurance premiums applicable to that
 
16 employee."
 
17      2.  By amending subsection (h) to read:
 
18      "(h)  Notwithstanding any other law to the contrary,
 
19 retirement benefits for the optional retirement system of the
 
20 University of Hawaii shall not be a subject of collective
 
21 bargaining negotiations for bargaining unit (7)."
 
22      SECTION 3.  Statutory material to be repealed is bracketed.
 
23 New statutory material is underscored.
