Permits the DOE to rehire retired teachers for 1 school year
while allowing them to receive retirement benefits on a temporary

                   A  BILL  FOR  AN  ACT
RELATING TO REHIRING RETIRED TEACHERS IN THE DEPARTMENT OF
   EDUCATION.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  The department of education in its efforts to
 
 2 provide quality education for all students, continues to seek
 
 3 viable solutions to address its recruitment needs in maintaining
 
 4 a teacher applicant pool capable of addressing continuing teacher
 
 5 shortages in areas such as special education, mathematics,
 
 6 science, industrial arts, and Hawaiian immersion.  Less severe
 
 7 shortages also exist for English teachers.  Neighbor Island
 
 8 schools, particularly schools in more isolated areas, are
 
 9 experiencing shortages in all fields.
 
10      The pool of applicants for these shortage areas is projected
 
11 to exist for at least another five years.  Given the fact that
 
12 the pool of applicants for the aforementioned shortage areas must
 
13 be rebuilt each year because fully certified applicants in
 
14 shortage fields are quickly depleted, the legislature believes
 
15 that there are high quality teachers who participated in the 1995
 
16 early retirement incentive program who, provided they could be
 
17 rehired on a full-time basis without loss of their current
 
18 retirement benefits, would be willing to return to a classroom
 
19 teaching position on a year-to-year basis, until the shortage

 1 areas no longer exist.
 
 2      SECTION 2.  The department of education may employ, for the
 
 3 2000 to 2001 school year, retired teachers at up to one hundred
 
 4 per cent full-time equivalents in teacher shortage areas
 
 5 identified by the department, with prior approval of the
 
 6 superintendent of education and pursuant to collective bargaining
 
 7 agreements.  The specific provisions of sections 88-21, 88-42.5,
 
 8 88-43, 88-45, and 88-46, Hawaii Revised Statutes, and any other
 
 9 statute to the contrary notwithstanding, those retired teachers
 
10 who are rehired shall not earn retirement service credit,
 
11 contribute to the retirement system, or gain additional
 
12 retirement system benefits as a result of such employment;
 
13 provided that the retired teacher shall continue to receive
 
14 entitled normal retirement benefits without penalty.
 
15      SECTION 3.  This Act shall take effect upon its approval and
 
16 shall be repealed on August 1, 2001.
