                   A  BILL  FOR  AN  ACT

RELATING TO PRECIOUS METALS.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 482D-1, Hawaii Revised Statutes, is
 
 2 amended by amending the definition of "stamped" to read as
 
 3 follows:
 
 4      ""Stamped" means branded[,] or engraved[, or printed] on the
 
 5 article[ or upon any sign, tag, card, label, box, package, cover,
 
 6 or wrapper used to encase, enclose, display or promote the
 
 7 article]."
 
 8      SECTION 2.  Section 482D-6, Hawaii Revised Statutes, is
 
 9 amended as follows:
 
10      1.  By amending subsection (a) to read:
 
11      "(a)  No article of merchandise bearing a quality or
 
12 fineness mark made in whole or in part of gold or silver or of an
 
13 alloy of either metal shall be sold, offered for sale, imported
 
14 into, or exported from the State unless it is stamped, branded,
 
15 or engraved with a trademark that has been registered under the
 
16 laws of the United States or applied for registration within
 
17 thirty days of being imported or offered for sale in the State."
 
18      2.  By amending subsection (c) to read:
 
19      "(c)  Each identifying trademark applied to any article of
 
20 merchandise in compliance with this section shall be applied,

 1 stamped, or branded in a position as close as possible to the
 
 2 quality mark or stamp and shall be as clear and legible as the
 
 3 quality mark."
 
 4      SECTION 3.  Statutory material to be repealed is bracketed.
 
 5 New statutory material is underscored.
 
 6      SECTION 4.  This Act shall take effect upon its approval.
