                   A  BILL  FOR  AN  ACT

RELATING TO THE PUBLIC EMPLOYEES HEALTH FUND.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Chapter 87, Hawaii Revised Statutes, is amended
 
 2 by adding a new section to be appropriately designated and to
 
 3 read as follows:
 
 4      "�87-     Medicare risk contract.  The board is authorized
 
 5 to negotiate with a carrier to provide a Medicare plus Choice
 
 6 program or programs for employee-beneficiaries who are eligible
 
 7 for the federal Medicare plan.  If benefits provided under a
 
 8 Medicare plus Choice program exclude reimbursement or services
 
 9 for health care provided to eligible employee-beneficiaries or
 
10 their dependents who have not yet reached the age of sixty-five,
 
11 the board is further authorized to negotiate the inclusion of
 
12 these benefits into a Medicare plus Choice contract for eligible
 
13 employee-beneficiaries who are retired, or provide supplemental
 
14 reimbursement for these excluded or limited benefits or services;
 
15 provided these benefits or services would otherwise be covered
 
16 under a comparable plan provided to eligible employee-
 
17 beneficiaries not covered by Medicare and are not considered out-
 
18 of-area or non-network benefits under the Medicare plus Choice
 
19 program that is provided.  The board shall negotiate Medicare

 1 plus Choice contracts where reimbursement is based on the same
 
 2 percentage of cost basis as the cost that would be reimbursed if
 
 3 the retired employee-beneficiary were covered by a health plan
 
 4 offered by the fund."
 
 5      SECTION 2.  New statutory material is underscored.
 
 6      SECTION 3.  This Act shall take effect upon its approval.
