                   A  BILL  FOR  AN  ACT

RELATING TO THE DUTIES OF THE BOARD OF NURSING.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 457-5, Hawaii Revised Statutes, is
 
 2 amended by amending subsection (a) to read as follows:
 
 3      "(a)  In addition to any other powers and duties authorized
 
 4 by law, the board may:
 
 5      (1)  Adopt, amend, or repeal rules, pursuant to chapter 91,
 
 6           not inconsistent with the law, as may be necessary to
 
 7           enable it to carry into effect this chapter, including
 
 8           the definition of the scope of practice of nursing and
 
 9           the delegation of nursing tasks based upon professional
 
10           nursing standards[;], which include but are not limited
 
11           to the standards set forth by national certifying
 
12           bodies recognized by the board;
 
13      (2)  Prescribe standards for preparing persons for licensure
 
14           of practical nurses and registered nurses and for
 
15           recognition of advanced practice registered nurses
 
16           under this chapter;
 
17      (3)  [Provide for] Conduct surveys of educational programs
 
18           as it may deem necessary[;] and practical;
 
19      (4)  [Accredit] Approve educational programs [as] which meet

 1           the requirements of this chapter and the rules of the
 
 2           board;
 
 3      (5)  Deny or withdraw [accreditation from] approval of
 
 4           educational programs for failure to meet or maintain
 
 5           the standards prescribed [standards;] in this chapter;
 
 6      (6)  [Examine, license, and renew the licenses of] License
 
 7           qualified applicants[;] by examination or endorsement,
 
 8           recognize advanced practice registered nurses, and
 
 9           renew, reinstate, and restore licenses and
 
10           recognitions;
 
11      (7)  Conduct hearings upon request of a denied applicant or
 
12           upon charges calling for discipline of a licensee [or,
 
13           denial, suspension, or revocation of a license];
 
14      (8)  Exercise the power to issue subpoenas, compel the
 
15           attendance of witnesses, and administer oaths to
 
16           persons giving testimony at hearings;
 
17      (9)  Cause the prosecution of all persons violating this
 
18           chapter and incur necessary expenses therefor; [and]
 
19     (10)  Keep a record of all its proceedings[.];
 
20     (11)  Provide consultation, conduct conferences, forums,
 
21           studies, and research on nursing education and
 
22           practice;
 
23     (12)  Communicate with national organizations that promote

 1           the improvement of the legal standards of practice of
 
 2           nursing for the protection of public health, safety,
 
 3           and welfare;
 
 4     (13)  Authorize the administration of examinations to
 
 5           eligible applicants for licensure as registered nurses
 
 6           or licensed practical nurses, or other examinations
 
 7           required by the board as designated in its rules;
 
 8     (14)  Employ, contract, and cooperate, to the extent
 
 9           allowable by law, with any board-approved organization
 
10           in the preparation and grading of an appropriate
 
11           nationally uniform examination, provided the board
 
12           shall retain sole discretion and responsibility for
 
13           determining the standard of successful completion of
 
14           such an examination.  When such a national examination
 
15           is utilized, access to questions and answers shall be
 
16           restricted by the board; and
 
17     (15)  Develop and adopt rules as necessary relating to the
 
18           practice of nursing in telehealth."
 
19      SECTION 2.  Statutory material to be repealed is bracketed.
 
20 New statutory material is underscored.
 
21      SECTION 3.  This Act shall take effect upon its approval.
