                   A  BILL  FOR  AN  ACT

RELATING TO NEW CENTURY CHARTER SCHOOLS.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  The purpose of this Act is to require the
 
 2 superintendent of education, rather than the auditor, to
 
 3 determine the appropriate allocation of state general funds to
 
 4 new century charter schools based upon the operational and
 
 5 educational funding requirements of the schools, beginning in
 
 6 fiscal year 2000-2001.  This Act is necessary in order to ensure
 
 7 the equitable allocation of limited state general funds to all
 
 8 public schools, including new century charter schools.
 
 9      SECTION 2.  Section 302A-1185, Hawaii Revised Statutes, is
 
10 amended by amending subsection (a) to read as follows:
 
11      "(a)  New century charter schools shall receive an
 
12 allocation of state general funds based upon the operational and
 
13 educational funding requirements of the schools; provided that:
 
14      (1)  Beginning in fiscal year [1999-2000,] 2000-2001, and
 
15           every year thereafter, the [auditor] superintendent
 
16           shall determine the appropriate allocation based on the
 
17           total department general fund appropriation and per
 
18           pupil expenditure for the previous year[; provided that
 
19           in setting the allocation, the auditor shall explicitly

 1           consider the advice of the superintendent and indicate
 
 2           in the final determination the manner in which that
 
 3           advice was accommodated];
 
 4      (2)  Small schools shall be given a state subsidy or small
 
 5           school allotment to augment the per pupil allocation
 
 6           given; provided that if additional federal grant moneys
 
 7           are received, the [auditor] superintendent shall
 
 8           determine the appropriate portion of the federal grant
 
 9           moneys to be used to offset the small school allotment;
 
10           provided further that the federal grant moneys shall
 
11           not include federal impact aid;
 
12      (3)  The [auditor] superintendent shall take into
 
13           consideration any changes to the department's budget by
 
14           the legislature and any applicable collective
 
15           bargaining negotiated amounts; and
 
16      (4)  The allocation for self-contained special education
 
17           students and for other special education students shall
 
18           be adjusted appropriately to reflect the additional
 
19           expenses incurred for students in these programs;
 
20           provided that any increment to the per pupil allocation
 
21           made in this paragraph shall not exceed that available
 
22           to other public schools."

 1      SECTION 3.  Statutory material to be repealed is bracketed.
 
 2 New statutory material is underscored.
