                   A  BILL  FOR  AN  ACT

RELATING TO THE ENVIRONMENTAL HEALTH EDUCATION FUND.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 321-27, Hawaii Revised Statutes, is
 
 2 amended to read as follows:
 
 3      "�321-27  Environmental health education fund.(a)  There
 
 4 is established within the department of health an environmental
 
 5 education fund into which shall be deposited all moneys collected
 
 6 from fees for permits, licenses, inspections, various
 
 7 certificates, variances, investigations, and reviews, pursuant to
 
 8 sections 321-11.5(c) and 321-15.
 
 9      (b)  Moneys in the fund shall be expended by the department
 
10 for the purpose of enhancing the capacity of environmental health
 
11 programs to:
 
12      (1)  Improve public outreach efforts and consultations to
 
13           industries regulated;
 
14      (2)  Educate the public, staff, and industries regulated
 
15           thereunder;
 
16      (3)  Plan for future growth and expansion to meet emerging
 
17           needs;
 
18      (4)  Provide training opportunities to ensure the
 
19           maintenance of professional competence among

 1           environmental health staff and administrators[.
 
 2      Not more than $90,000 of the fund may be utilized during any
 
 3 fiscal year for fund administration, including the hiring of not
 
 4 more than two full-time equivalent personnel, and the purchase of
 
 5 office and electronic equipment.]; and
 
 6      (5)  Provide fiscal support for program activities as
 
 7           defined by subsection (b).
 
 8      [(c)  Any amount in the fund in excess of $300,000 on
 
 9 June 30 of each year shall be deposited into the general fund.
 
10      (d)] (c)  The department of health shall submit a report to
 
11 the legislature concerning the status of the environmental health
 
12 education fund, including, but not limited to, the amount of
 
13 moneys taken in by and expended from the fund, and the sources of
 
14 receipts and uses of expenditures, not less than twenty days
 
15 prior to the convening of each regular session."
 
16      SECTION 2.  Statutory material to be repealed is bracketed.
 
17 New statutory material is underscored.
 
18      SECTION 3.  This Act shall take effect upon its approval.
