                   A  BILL  FOR  AN  ACT

RELATING TO HIGHWAYS GENERALLY.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 264-6, Hawaii Revised Statutes, is
 
 2 amended to read as follows:
 
 3      "§264-6  State highway not to be disturbed without permit.
 
 4 No person or government agency, whether federal, state, or
 
 5 county, shall, in any manner or for any purpose do any of the
 
 6 following acts without a written permit from the director of
 
 7 transportation or the director's authorized representative:
 
 8      (1)  Break up, dig up, disturb, undermine or dig under, or
 
 9           cause to be broken up, dug up, disturbed, undermined,
 
10           or dug under, the right-of-way of any state highway; or
 
11      (2)  Place, erect, leave, or store any structure, motor or
 
12           other vehicle, equipment, or any other object wholly or
 
13           partially within the right-of-way of any state highway;
 
14           provided that this paragraph shall not apply to the
 
15           holding or displaying of handheld, movable signs, for
 
16           the purpose of carrying on political campaign
 
17           activities [.] by persons who are situated a safe
 
18           distance from the paved travelways, in plain sight, and
 
19           between sunrise and sunset.  All signs must be

 1           removed."
 
 2      SECTION 2.  Statutory material to be repealed is bracketed.
 
 3 New statutory material is underscored.
 
 4      SECTION 3.  This Act shall take effect upon its approval.
