                   A  BILL  FOR  AN  ACT

RELATING TO EMPLOYMENT COMPENSATION IN THE JUDICIARY.
 


BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  The legislature finds that in the haste of
 
 2 concluding conference committee deliberations during the 1999
 
 3 legislative session and preparing the conference committee report
 
 4 on H.B. No. 20, C.D. 1, an unfortunate and unintended
 
 5 inconsistency resulted with reference to the specific salary
 
 6 figures in the bill and the intent of the conference committee.
 
 7 Remarks read into the journal on the floor of the Senate and
 
 8 House regarding H.B. No. 20, C.D. 1, clearly stated the intent of
 
 9 the conference committee and its recommendation that the
 
10 legislature during the regular session of 2000 correct the
 
11 judicial salary figures to represent the intended eleven per cent
 
12 increase effective July 1, 1999, and eleven per cent increase
 
13 effective July 1, 2000.  Because H.B. No. 20, C.D. 1, which is
 
14 now Act 65, Session Laws of Hawaii 1999, provided for specific
 
15 salary increases of only four per cent effective July 1, 1999,
 
16 and four per cent effective July 1, 2000, the legislature finds
 
17 that it is necessary to amend the statutes to reflect the correct
 
18 figures as intended by the conference committee.  Accordingly,
 
19 the purpose of this Act is to increase judicial salaries by seven

 1 per cent beginning July 1, 1999, and by eleven per cent beginning
 
 2 July 1, 2000, to reflect the salary increase intended by the
 
 3 legislature during the regular session of 1999.
 
 4      SECTION 2.  Section 602-2, Hawaii Revised Statutes, is
 
 5 amended to read as follows:
 
 6      "�602-2 Salary, supreme court justices.  Effective July 1,
 
 7 1999, the salary of the chief justice of the supreme court shall
 
 8 be [$98,571] $105,206 a year and the salary of each associate
 
 9 justice of the supreme court shall be [$97,531] $104,096 a year.
 
10 Effective July 1, 2000, the salary of the chief justice of the
 
11 supreme court shall be [$102,514] $116,779 a year and the salary
 
12 of each associate justice of the supreme court shall be
 
13 [$101,432] $115,547 a year."
 
14      SECTION 3.  Section 602-52, Hawaii Revised Statutes, is
 
15 amended to read as follows:
 
16      "�602-52  Salary.  Effective July 1, 1999, the salary of the
 
17 chief judge of the intermediate appellate court shall be
 
18 [$94,931] $101,321 a year and the salary of each associate judge
 
19 shall be [$93,371] $99,656 a year.  Effective July 1, 2000, the
 
20 salary of the chief judge of the intermediate appellate court
 
21 shall be [$98,728] $112,466 a year and the salary of each
 
22 associate judge shall be [$97,106] $110,618 a year."
 
23      SECTION 4.  Section 603-5, Hawaii Revised Statutes, is

 1 amended to read as follows:
 
 2      "�603-5 Salary of circuit court judges.  Effective July 1,
 
 3 1999, the salary of each circuit court judge of the various
 
 4 circuit courts of the State shall be [$90,251] $96,326 a year.
 
 5 Effective July 1, 2000, the salary of each circuit court judge of
 
 6 the various circuit courts of the State shall be [$93,861]
 
 7 $106,922 a year."
 
 8      SECTION 5.  Section 604-2.5, Hawaii Revised Statutes, is
 
 9 amended to read as follows:
 
10      "�604-2.5  Salary of district judges.  Effective July 1,
 
11 1999, the salary of each district court judge of the various
 
12 district courts of the State shall be [$85,051] $90,777 a year.
 
13 Effective July 1, 2000, the salary of each district court judge
 
14 of the various district courts of the State shall be [$88,453]
 
15 $100,761 a year.
 
16      Whenever the chief justice appoints a district court judge
 
17 of any of the various district courts of the State to serve
 
18 temporarily as a circuit court judge of any of the various
 
19 circuit courts of the State, the judge shall receive per diem
 
20 compensation for the days on which actual service is rendered,
 
21 based on the monthly rate of compensation paid to a circuit court
 
22 judge.  For the purpose of determining per diem compensation in
 
23 this section, a month shall be deemed to consist of twenty-one

 1 days."
 
 2      SECTION 6.  Statutory material to be repealed is bracketed.
 
 3 New statutory material is underscored.
 
 4      SECTION 7.  This Act, upon its approval, shall take effect
 
 5 retroactive to July 1, 1999.
