                   A  BILL  FOR  AN  ACT

RELATING TO THE PUBLIC EMPLOYEES HEALTH FUND.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 87-11, Hawaii Revised Statutes, is
 
 2 amended to read as follows:
 
 3      "�87-11  Composition of board.  The board of trustees shall
 
 4 consist of [nine trustees, three of whom shall be representatives
 
 5 from different organizations representing public employees, three
 
 6 from different private business organizations, a member of the
 
 7 clergy, a teacher, and the director of finance or a designated
 
 8 representative.] an equal number of employee and public employer
 
 9 representatives.  The employee representatives shall consist of
 
10 one representative from each of the organizations certified as an
 
11 exclusive representative for State and county employees and one
 
12 retiree of the employees' retirement system to be elected by the
 
13 members and retirees of the system under rules adopted by the
 
14 board governing the election to serve for a term of six years to
 
15 expire on January 1 of the sixth year; provided that if after the
 
16 close of filing of petitions for candidacy, a member is unopposed
 
17 for election to a trustee position, the member shall be deemed to
 
18 be duly elected to the position of trustee without an election.
 
19 The public employer representatives shall consist of two
 
20 representatives from the State appointed by the governor, one

 1 representative from the judiciary appointed by the chief justice,
 
 2 and a representative from each of the four counties appointed by
 
 3 the mayor of the respective county.  If the number of employee
 
 4 organizations changes, and there is a need for a reduction or
 
 5 increase in the number of employer representatives, the employer
 
 6 representatives listed above shall determine which jurisdiction
 
 7 representatives shall be deleted or added."
 
 8      SECTION 2.  Section 87-13, Hawaii Revised Statutes, is
 
 9 amended to read as follows:
 
10      "�87-13  Term of a trustee; vacancy.  [Except for the
 
11 director of finance, the] The term of office of [each trustee]
 
12 the retiree shall be [four] six years.  The [director of finance]
 
13 respective public employer and employee organization
 
14 representatives shall serve [during the director's term of office
 
15 as director of finance.] at the discretion of the chief executive
 
16 or employee organization director.
 
17      A vacancy of the retiree position on the board [of trustees]
 
18 shall be filled by appointment of the governor[.] if less than
 
19 two years remain of a retiree's term.  If two or more years
 
20 remain of a retiree's term, a new election shall be held to fill
 
21 the vacancy.  The person appointed to fill a vacancy shall serve
 
22 for the remainder of the term of the person's predecessor.

 1      If by the end of the trustee's term a trustee is not
 
 2 reappointed or the trustee's successor is not appointed, the
 
 3 trustee shall serve until the trustee's successor is appointed."
 
 4      SECTION 3.  Statutory material to be repealed is bracketed.
 
 5 New statutory material is underscored.
 
 6      SECTION 4.  This Act shall take effect on January 1, 2001.
