                     A BILL FOR AN ACT

PROPOSING AN AMENDMENT TO ARTICLE IV, SECTION 4, OF THE HAWAII
   CONSTITUTION RELATING TO APPORTIONMENT AMONG BASIC ISLAND
   UNITS.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:


 1      SECTION 1.  The purpose of this Act is to propose an
 
 2 amendment to Article IV, Section 4, of the Constitution of the
 
 3 State of Hawaii to change the apportionment base from total
 
 4 population to an eligible voter base.
 
 5      SECTION 2.  Article IV, Section 4, of the Constitution of
 
 6 the State of Hawaii is amended to read as follows:
 
 7              "APPORTIONMENT AMONG BASIC ISLAND UNITS
 
 8      Section 4. The commission shall allocate the total number of
 
 9 members of each house of the state legislature being
 
10 reapportioned among the four basic island units, namely: (1) the
 
11 island of Hawaii, (2) the islands of Maui, Lanai, Molokai and
 
12 Kahoolawe, (3) the island of Oahu and all other islands not
 
13 specifically enumerated, and (4) the islands of Kauai and Niihau,
 
14 using the total number of [permanent residents] eligible voters
 
15 in each of the basic island units and computed by the method
 
16 known as the method of equal proportions; except that no basic
 
17 island unit shall receive less than one member in each house."
 
18      SECTION 3. The question to be printed on the ballot shall be

 1 as follows:
 
 2      "Shall the current constitutional requirements for the
 
 3 apportionment of legislative seats among the basic island units
 
 4 be amended to provide that the size of state house and senate
 
 5 districts be calculated based on the number of eligible voters?"
 
 6      SECTION 4.  Constitutional material to be repealed is
 
 7 bracketed.  New Constitutional material is underscored.
 
 8      SECTION 5.  This amendment shall take effect upon compliance
 
 9 with Article XVII, section 3, of the Constitution of the State of
 
10 Hawaii.
