                     A BILL FOR AN ACT

RELATING TO TORT ACTIONS.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:


 1      SECTION 1.  Section 663-8.7, Hawaii Revised Statutes, is
 
 2 amended to read as follows:
 
 3      "[�663-8.7]  Limitation on pain and suffering.  [Repeal of
 
 4 section on October 1, 1995, by L 1993, c 238, �1 deleted by L
 
 5 1995, c 130, �1.]  Damages recoverable for pain and suffering as
 
 6 defined in section 663-8.5 shall be limited to a maximum award of
 
 7 [$375,000; provided that this limitation shall not apply to tort
 
 8 actions enumerated in section 663-10.9(2).] $275,000."
 
 9      SECTION 2.  Statutory material to be repealed is bracketed.
 
10 New statutory material is underscored.
 
11      SECTION 3.  This Act shall take effect upon its approval.
