                   A  BILL  FOR  AN  ACT

RELATING TO HAWAIIAN FISHPONDS.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 171-28, Hawaii Revised Statutes, is
 
 2 amended to read as follows:
 
 3      "�171-28  Government-owned Hawaiian fish ponds.(a)  The
 
 4 board may investigate and develop scientific or traditional,
 
 5 commercial or subsistence management practices for government-
 
 6 owned Hawaiian fish ponds and reconstruct, rehabilitate, improve,
 
 7 and stock the fish ponds; and expend moneys from the special land
 
 8 and development fund.  All revenues derived from any government-
 
 9 owned Hawaiian fish pond shall be deposited in the fund.
 
10      (b)  The board, only with the concurrence of the chairperson
 
11 of the office of Hawaiian affairs or a designee as a signatory,
 
12 may lease government-owned Hawaiian fish ponds with legislative
 
13 authorization as provided under section 171-53(c); provided that
 
14 in lieu of legislative authorization, the board and the
 
15 chairperson of the office of Hawaiian affairs or a designee may
 
16 lease such fish ponds if:
 
17      (1)  A public hearing is conducted on the proposed lease on
 
18           the island where the fish pond is located;
 
19      (2)  The board [finds] and the chairperson of the office of

 1           Hawaiian affairs or a designee find that the proposed
 
 2           lease does not cause a substantial adverse
 
 3           environmental or ecological impact on the fish pond or
 
 4           surrounding area; and
 
 5      (3)  The proposed lease is not in violation of applicable
 
 6           federal, state, or county laws."
 
 7      SECTION 2.  Statutory material to be repealed is bracketed.
 
 8 New statutory material is underscored.
 
 9      SECTION 3.  This Act shall take effect upon its approval.
