Requires the department of accounting and general services to

maintenance, and removal of security cameras on privately-owned
school buses used to carry out the purposes of the student

                   A  BILL  FOR  AN  ACT

RELATING TO SECURITY CAMERAS ON SCHOOL BUSES.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Subject to the availability of funds and with
 
 2 the permission of a private school bus company, the department of
 
 3 accounting and general services shall provide for the purchase,
 
 4 installation, operation, repair, maintenance, and removal of
 
 5 security cameras on privately-owned school buses used to carry
 
 6 out the purposes of section 302A-406, Hawaii Revised Statutes.
 
 7 Any security camera purchased by the department of accounting and
 
 8 general services pursuant to this Act shall remain the property
 
 9 of the State at all times, whether or not the bus is being used
 
10 to carry out the purposes of section 302A-406.  Nothing in this
 
11 Act shall be construed to give ownership of a security camera to
 
12 a private bus company.  A bus company shall be liable to the
 
13 State for the negligent loss, damage, breakage, or destruction of
 
14 a security camera, up to the replacement value of the camera.
 
15      Any contract for school bus services that fails to provide
 
16 for the security cameras required by this Act shall be void.
 
17      SECTION 2.  There is appropriated out of the general
 
18 revenues of the State of Hawaii the sum of $        , or so much
 
19 thereof as may be necessary for fiscal year 1999-2000, and the

 1 sum of $        , or so much thereof as may be necessary for
 
 2 fiscal year 2000-2001, to provide security cameras on school
 
 3 buses.
 
 4      SECTION 3.  The sums appropriated shall be expended by the
 
 5 department of accounting and general services for the purposes of
 
 6 this Act.
 
 7      SECTION 4.  This Act shall take effect on July 1, 1999.
