                   A  BILL  FOR  AN  ACT

RELATING TO SALARIES IN THE JUDICIARY.
 


BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 602-2, Hawaii Revised Statutes, is
 
 2 amended to read as follows:
 
 3      "�602-2 Salary, supreme court justices.  Effective
 
 4 January 1, [1989,] 1999, the salary of the chief justice of the
 
 5 supreme court shall be [$90,699] $__________ a year and the
 
 6 salary of each associate justice of the supreme court shall be
 
 7 [$89,699] $__________ a year.  Effective January 1, [1990,] 2000,
 
 8 the salary of the chief justice of the supreme court shall be
 
 9 [$94,780] $__________ a year and the salary of each associate
 
10 justice of the supreme court shall be [$93,780] $__________ a
 
11 year."
 
12      SECTION 2.  Section 602-52, Hawaii Revised Statutes, is
 
13 amended to read as follows:
 
14      "�602-52  Salary.  Effective January 1, [1989,] 1999, the
 
15 salary of the chief judge of the intermediate appellate court
 
16 shall be [$87,199] $__________ a year and the salary of each
 
17 associate judge shall be [$85,699] $____________ a year.
 
18 Effective January 1, [1990,] 2000, the salary of the chief judge

 1 of the intermediate appellate court shall be [$91,280]
 
 2 $___________ a year and the salary of each associate judge shall
 
 3 be [$89,780] $____________ a year."
 
 4      SECTION 3.  Section 603-5, Hawaii Revised Statutes, is 
 
 5 amended to read as follows:
 
 6      "�603-5 Salary of circuit court judges.  Effective
 
 7 January 1, [1989,] 1999, the salary of each circuit court judge
 
 8 of the various circuit courts of the State shall be [$82,699]
 
 9 $__________ a year.  Effective January 1, [1990,] 2000, the
 
10 salary of each circuit court judge of the various circuit courts
 
11 of the State shall be [$86,780] $__________ a year." 
 
12      SECTION 4.  Section 604-2.5, Hawaii Revised Statutes, is
 
13 amended to read as follows:
 
14      "�604-2.5  Salary of district judges.  Effective January 1,
 
15 [1989,] 1999, the salary of each district court judge of the
 
16 various district courts of the State shall be [$77,699]
 
17 $__________ a year.  Effective January 1, [1990,] 2000 the salary
 
18 of each district court judge of the various district courts of
 
19 the State shall be [$81,780] $__________ a year.
 
20      Whenever the chief justice appoints a district court judge
 
21 of any of the various district courts of the State to serve
 
22 temporarily as a circuit court judge of any of the various

 1 circuit courts of the State, the judge shall receive per diem
 
 2 compensation for the days on which actual service is rendered
 
 3 based on the monthly rate of compensation paid to a circuit court
 
 4 judge.  For the purpose of determining per diem compensation in
 
 5 this section, a month shall be deemed to consist of twenty-one
 
 6 days."
 
 7      SECTION 5.  There is appropriated out of the general
 
 8 revenues of the State of Hawaii the sum of $          , or so
 
 9 much thereof as may be necessary for fiscal year 1998-1999, and
 
10 the sum of $          , or so much thereof as may be necessary
 
11 for fiscal year 1999-2000, for judicial salaries.
 
12      SECTION 6.  The sum appropriated shall be expended by the
 
13 judiciary for the purposes of this Act.
 
14      SECTION 7.  Statutory material to be repealed is bracketed.
 
15 New statutory material is underscored.
 
16      SECTION 8.  This Act shall take effect upon its approval,
 
17 provided that this Act shall not take effect unless legislation
 
18 requiring judicial retention elections and regulating judicial
 
19 campaigns has been enacted.
