                   A  BILL  FOR  AN  ACT


RELATING TO ATHLETIC HEALTH CARE SPECIALISTS.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  The purpose of this Act is to convert to
 
 2 permanent status fifteen full-time equivalent temporary athletic
 
 3 health care specialist positions in the department of education;
 
 4 require that athletic health care specialists in the department
 
 5 of education possess certification by the National Athletic
 
 6 Trainers Association, Board of Certification; and exempt
 
 7 incumbent athletic trainers from minimum qualification
 
 8 requirements.
 
 9      The legislature finds that Act 355, Session Laws of Hawaii
 
10 1993, provided funding for a pilot athletic trainer program.  The
 
11 incumbents have served as pioneers in establishing viable
 
12 athletic health care programs at their assigned schools.  The
 
13 legislature further finds that the department of education has
 
14 made strong efforts to initially recruit qualified applicants for
 
15 these positions and conversion to permanent status will help to
 
16 provide employment security and needed stability for continued
 
17 program development.
 
18      SECTION 2.  The department of education is authorized to
 
19 convert to permanent status fifteen full-time equivalent general
 
20 funded temporary athletic health care specialist positions;

 1 provided that the department, at its discretion, may hire into
 
 2 the permanent positions the incumbent employees of those
 
 3 positions, and if the incumbent employees are hired they shall be
 
 4 rehired without loss of salary, seniority, prior service credit,
 
 5 accrued vacation, sick leave, or other employee benefits or
 
 6 privileges and without the necessity of examination; and provided
 
 7 further that any employee converted pursuant to this section
 
 8 shall have performed work satisfactorily for a period of not less
 
 9 than six months prior to the effective date of this Act.
 
10      SECTION 3.  The department of education shall require as a
 
11 minimum qualification that athletic health care specialists
 
12 possess certification by the National Athletic Trainers
 
13 Association, Board of Certification; provided that an incumbent
 
14 athletic trainer previously hired with other acceptable
 
15 qualifications shall be exempted from this provision upon being
 
16 converted under section 2 of this Act.
 
17      SECTION 4.  This Act shall take effect on July 1, 1999.
