                   A  BILL  FOR  AN  ACT

RELATING TO THE CLEAN HAWAII FUND.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Chapter 201, Hawaii Revised Statutes, is amended
 
 2 by adding to part VIII a new section to be appropriately
 
 3 designated and to read as follows:
 
 4      "�201-     Definitions.  As used in this part:
 
 5      "Director" means the director of business, economic
 
 6 development, and tourism.
 
 7      "Department" means the department of business, economic
 
 8 development, and tourism."
 
 9      SECTION 2.  Chapter 201, Hawaii Revised Statutes, is amended
 
10 by adding to part VIII a new section to be appropriately
 
11 designated and to read as follows:
 
12      "�201-     Clean Hawaii fund established.  (a)  There is
 
13 established within the state treasury a special fund to be known
 
14 as the clean Hawaii fund which shall be administered and used by
 
15 the department for the purpose of marketing and promoting the
 
16 development of local processing and manufacturing industries for
 
17 collected recyclables.  All moneys derived from the following
 
18 sources shall be deposited into the fund:
 
19      (1)  Other funding mechanisms established by future state

 1           laws;
 
 2      (2)  All moneys appropriated to the fund by the legislature,
 
 3           received in fees and other royalties, earned on
 
 4           investments, or received as royalties or premiums; and
 
 5      (3)  Any other moneys as may be received by the department
 
 6           to market and promote the development of local
 
 7           processing and manufacturing industries for collected
 
 8           recyclables in the form of federal, state, county, or
 
 9           private grants, contracts, gifts, or direct transfer of
 
10           funds by federal, county, or other state agencies.
 
11      (b)  The department may use appropriations and other moneys
 
12 in the clean Hawaii fund for the following purposes:
 
13      (1)  To make grants for marketing and promoting the
 
14           development of local processing and manufacturing
 
15           industries for collected recyclables and subject to the
 
16           standards provided in section 42F-103;
 
17      (2)  To pay for any and all expenses, fees, or costs related
 
18           to the marketing, promotion, or development of local
 
19           processing, manufacturing, or purchasing of recycled
 
20           products; or
 
21      (3)  To pay for any and all expenses, fees, or costs to
 
22           organize, conduct, sponsor, or cooperate in the conduct

 1           of conferences, workshops, demonstrations, studies, or
 
 2           other events or functions that are related to the
 
 3           stimulation and formation of a recycling or
 
 4           environmental business.
 
 5      (c)  The director shall have the authority to execute
 
 6 contracts and to adopt rules pursuant to chapter 91 to implement
 
 7 the purposes of the clean Hawaii fund."
 
 8      SECTION 3.  Act 202, Session Laws of Hawaii 1994, as amended
 
 9 by Act 2, Special Session Laws of Hawaii 1995, and Act 83,
 
10 Session Laws of Hawaii 1996, is amended by amending section 9 to
 
11 read as follows:
 
12      "SECTION 9.  The clean Hawaii center shall cease to exist on
 
13 June 30, 1999; provided that on June 29, 1999, all unexpended or
 
14 unencumbered balances remaining in the clean Hawaii fund
 
15 established in section 4 of Act 2, Special Session Laws of Hawaii
 
16 1995, shall be transferred to the [Hawaii capital loan program]
 
17 clean Hawaii fund established by Act    , Session Laws of Hawaii
 
18 1999.  Section [210-   ] 210-3.5, Hawaii Revised Statutes, shall
 
19 be repealed on June 30, 1999."
 
20      SECTION 4.  In printing this Act, the revisor of statutes
 
21 shall insert the appropriate number of this Act in section 3.
 
22      SECTION 5.  Statutory material to be repealed is bracketed.

 1 New statutory material is underscored.
 
 2      SECTION 6.  This Act shall take effect on June 27, 1999,
 
 3 except that sections 3 and 4 shall take effect on June 28, 1999.
