DESCRIPTION:
Authorizes the principal of each school to act as limited chief
procurement officer of the school.  Allows principals to issue
exemptions from procurement laws provided the exemptions are made
public.  Superintendent has authority to suspend principal's

                   A  BILL  FOR  AN  ACT

RELATING TO PROCUREMENT FOR SCHOOLS.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Schools are increasingly hampered in their
 
 2 initiatives by bureaucratic overhead and paperwork.  The
 
 3 procurement law is set up to ensure that a fair process will
 
 4 result in a competitive price.  Unfortunately, this sometimes
 
 5 cumbersome process often prevents schools from running
 
 6 efficiently.  Purchases are often unnecessarily restricted by
 
 7 waiting for approvals.  This is dramatically apparent in the
 
 8 schools' attempt to keep up with technology.  The legislature
 
 9 finds that the schools need some flexibility in procurement in
 
10 order to maintain desired standards.
 
11      The purpose of this Act is to authorize principals to make
 
12 purchases for their schools which may be exempt from the
 
13 procurement code.
 
14      SECTION 2.  Chapter 103D, Hawaii Revised Statutes, is
 
15 amended by adding a new section to be appropriately designated
 
16 and to read as follows:
 
17      "�103D-     Limited chief procurement officers.  (a)  Each
 
18 principal of each school shall be designated as a limited chief
 
19 procurement officer for the limited purpose of procurement for

 1 their respective school.  Principals shall be subject to this
 
 2 chapter and the rules adopted by the policy board.  A principal
 
 3 may exempt certain purchases from the requirements of this
 
 4 chapter and chapter 103, for the benefit of the school and
 
 5 students; provided that all exemptions shall be made public and
 
 6 published quarterly on a school-by-school basis.  The
 
 7 superintendent of education may suspend at the superintendent's
 
 8 discretion, a principal's authority as a limited chief
 
 9 procurement officer.
 
10      (b)  The policy board may adopt rules in accordance with
 
11 chapter 91 for the administration of this section."
 
12      SECTION 3.  New statutory material is underscored.
 
13      SECTION 4.  This Act shall take effect upon its approval.
