                   A  BILL  FOR  AN  ACT

RELATING TO CONSUMER PROTECTION.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Chapter 127, Hawaii Revised Statutes, is amended
 
 2 by adding a new section to be appropriately designated and to
 
 3 read as follows:
 
 4      "�127-    Adoption of hurricane resistant shelter criteria;
 
 5 construction of new public school buildings.  (a)  The adjutant
 
 6 general shall adopt hurricane resistant shelter criteria in
 
 7 accordance with chapter 91 to regulate the planning, design,
 
 8 construction, and equipping of new public school buildings built
 
 9 after June 30, 2000, that are designated by the State or counties
 
10 as hurricane shelters.
 
11      (b)  The hurricane resistant shelter criteria established by
 
12 the adjutant general on July 29, 1997, shall apply to the
 
13 planning, design, construction, and equipping of all new public
 
14 school buildings built before July 1, 2000, that are designated
 
15 by the State or counties as hurricane shelters."
 
16      SECTION 2.  Chapter 302A, Hawaii Revised Statutes, is
 
17 amended by adding a new section to part VI to be appropriately
 
18 designated and to read as follows:

 1      "�302A-    Construction of new school buildings; conformance
 
 2 with hurricane resistant shelter criteria.  (a)  All new school
 
 3 buildings planned, designed, constructed, and equipped after
 
 4 June 30, 2000, that are designated by the State or counties as
 
 5 hurricane shelters, shall be built in accordance with hurricane
 
 6 resistant shelter criteria, adopted by the adjutant general
 
 7 pursuant to section 127-   .
 
 8      (b)  To the maximum extent feasible, all new school
 
 9 buildings planned, designed, constructed, and equipped before
 
10 July 1, 2000, that are designated by the State or counties as
 
11 hurricane shelters, shall be built in accordance with hurricane
 
12 resistant shelter criteria established by the adjutant general on
 
13 July 29, 1997."
 
14      SECTION 3.  New statutory material is underscored.
 
15      SECTION 4.  This Act shall take effect upon its approval.
